For the purpose of this chapter, certain words and phrases shall be construed as set forth in this section:
"Garbage"
means any material that is destined to be disposed of at a landfill or transformation facility or any material that should, for health and safety reasons, be disposed of. This may include, but is not limited to, any refuse and waste material derived from the preparation, use, and consumption of meats and food, and all dead fish, animals, fowl, fruits, vegetables, combustible and noncombustible material, including ashes, wire, box strapping, packing materials, crockery, glass, brick, cement, motor vehicle bodies and discarded mechanisms, waste and all other material and matter similar to that mentioned in this section and any other noxious or offensive matter or material usually and ordinarily referred to as garbage or market refuse. "Garbage" does not include recyclable material.
"Recyclable"
material includes metals, glass, plastic, paper, cardboard, wood, yard trimmings, or any material that is separated from garbage and is destined to be reprocessed or reused.

All garbage or recyclable material stored on private premises shall be stored so as not to become a health or safety hazard.
There shall be no garbage dump, public or private, within the city.

No person other than the owner thereof or the waste hauler contracted by the city shall interfere in any manner with a garbage or recycling receptacle or the contents thereof, or remove any such receptacle or the contents thereof from the location where the same was placed by the owner. Nor shall any person contaminate, collect, scavenge, or destroy materials that are set out for recycling.
Nothing in this chapter shall limit the right of any individual, organization or other entity to donate or sell recyclable material; provided, that such handling and transport is in accordance with the provisions of this chapter.
Nothing in this chapter shall be deemed to limit the right of the authorized recycling contractor to bring a civil action against any person who violates the above described sections of the chapter, nor shall a conviction for such violation exempt any person from a civil action brought by an authorized recycling contractor.

No person shall deposit, keep or accumulate any garbage in or upon any lot or parcel of land, or upon any public or private drive, alley or street, or in any house, store or restaurant or other place unless such garbage is enclosed in a fly-proof, watertight receptacle with close-fitting cover and provided with handles.
Garbage cans shall have a capacity of not less than two gallons. Such receptacles shall be provided by and at the expense of the person producing and accumulating such garbage and shall be stored in the rear of the premises or out of sight and the contents thereof disposed of at least once each week.

No person shall permit a garbage receptacle to remain uncovered or open, or in such condition that flies or vermin may obtain access thereto, except when necessary to place garbage therein or remove garbage therefrom, and when the cover is removed therefrom for such purposes it shall be immediately replaced.

The 20-gallon receptacles shall have a weight of not more than 30 pounds and the 30- to 32-gallon receptacles shall have a weight of not more than 50 pounds. Garbage that does not fit in the receptacle must be contained in a designated bag which can be purchased from the city's contracted waste hauler.

All members of the police department and the city and county health officers are specifically required to enforce the provisions of this chapter and shall have the right to enter any and all premises for the purpose of determining the sanitary condition thereof. Enforcement of this chapter shall be in accordance with Sections 1822.50 to 1822.57 of the Civil Procedure Code of the state of California.
