This section of the code is authorized under Section 647(e) of the Penal Code which grants cities the right to control open alcoholic beverage containers near posted off-sale premises.

No person or persons may have in their possession any open alcoholic beverage container while on the posted premises which includes the posted parking lot or the public sidewalks immediately adjacent to any retail package off-sale alcoholic beverage licensee which has been posted under this chapter.

The signs must be clearly posted in both the retail business and the parking lot of the business. The wording will go as follows:
Notice: Possession of an open alcoholic beverage container on these premises parking lot, or adjacent sidewalk is a violation of Fortuna Municipal Code Chapter 9.16 and is punishable as an infraction.
