This title is adopted to supplement and implement the Subdivision Map Act, Sections 66410, et seq., of the Government Code as last amended, and may be cited as the "Subdivision Ordinance of Fortuna."

Whenever any words or phrases as used in the tile are not defined in this title but are defined in the Subdivision Map Act as last amended, such definitions are incorporated in this title and shall be deemed to apply as though set forth in this title.

As the local agency the city council shall approve, conditionally approve, or disapprove all maps for division of real property not specifically delegated to other agencies in this title.

The planning commission of the city shall constitute the advisory agency for all divisions of real property within the city. The advisory agency shall have the authority for the final approval, approval with conditions, or disapproval of parcel maps, except for those divisions cited in Section 66426 (a) through (d) of the Subdivision Map Act. The authority of the advisory agency may be delegated at its discretion.

The advisory agency established by FMC § 16.04.040 shall make investigations and reports on the design and improvement of all proposed divisions of real property and shall have the authority to impose requirements or conditions upon tentative maps, consistent with the Subdivision Map Act and ordinances of the city.

Final approval or disapproval of parcel maps under the authority of the advisory agency established in FMC § 16.04.040 may be delegated by the planning commission to the director of public works and/or the city engineer.

Urban lot splits, as authorized by Government Code Section 66411.7, are subdivisions subject to this title that shall be more specifically governed as set forth in Chapter 17.09 FMC.
