The mayor may accept unrestricted recurring donations in amounts or values up to and including $20,000 per year, excluding real estate, and credit such amounts to the city general fund without approval of the city council. Unrestricted recurring donations in excess of $20,000 per year shall be accepted only by action of the city council which shall specify the municipal purpose or purposes for which such donations may be used.

The mayor may accept restricted recurring donations in amounts or values up to and including $10,000 per year, excluding real estate, and credit such amounts to the appropriate city fund without further approval by the city council. Restricted recurring donations valued in excess of $10,000 per year shall be accepted only by action of the city council. The city shall not accept any donations with unlawful conditions.

If an appropriate city fund does not exist for the purpose for which a donation has been designated, the city council may establish one by ordinance. The ordinance shall specify the uses for which fund assets may be used and indicate how payments from it are authorized.
