A. 
Any act in violation of the provisions of this chapter 412, or any regulation promulgated by the Department, or any directive issued by the Department pursuant to this chapter or any regulation shall be deemed a violation of this chapter.
B. 
Violations shall include, but not be limited to:
(1) 
Conducting any part of a Cannabis Business or research or testing without a license.
(2) 
Conducting any part of a Cannabis Business or research or testing contrary to the terms of a license, including contrary to the terms of any suspension of a license.
(3) 
A cultivation or production licensee selling, providing, or in any way transferring cannabis to any person or entity other than a distribution licensee acting though licensed employees;
(4) 
A distribution licensee selling, providing, or in any way transferring cannabis to any person or entity other than a person holding a valid Medical Registration Card issued by the Member Services Department.
(5) 
Violation of any provision of this chapter or any rule or regulation adopted by the Department pursuant to this chapter.
A. 
Failure to comply with any or all parts of this chapter 412 shall result in a forfeiture of not less than $100 and not more than $1,000 per day for each day of noncompliance.
B. 
This chapter shall be enforced by the Menominee Tribal Police Department through the issuance of citations upon referral from the Department or its designated agent.
C. 
The Tribal Court shall have jurisdiction, upon petition of the Department through the Tribal Prosecutor, to enjoin any actions in violation of Chapter 412 where there is a substantial probability that death or serious physical harm could result to any person immediately or before the imminence of such danger can be eliminated through the enforcement procedures otherwise provided by this chapter 412. Any order issued under this section may require such steps to be taken as may be necessary to avoid, correct, or remove such danger.
