The ordinance codified in this chapter became operative December 9, 2024, upon voter approval of the city’s measure prohibiting the sale and establishment of certain psilocybin activities in the area subject to the jurisdiction of the city.

A. 
In November 2020, Oregon voters approved Ballot Measure 109, known as the Oregon Psilocybin Service Act (codified as ORS Chapter 475A), which allows for the manufacture, delivery, and administration of psilocybin at licensed facilities.
B. 
ORS 475A.235 provides that the Oregon Health Authority will regulate the manufacturing, transportation, delivery, sale, and purchase of psilocybin products and the provision of psilocybin services in the state.

The Oregon Health Authority initiated a rulemaking process to implement the state’s psilocybin regulatory program. Under Measure 109, cities may place referendums on local ballots to prohibit psilocybin product manufacturers and/or psilocybin service centers within their jurisdictions.
D. 
On September 12, 2022, the city council of Brookings adopted a resolution to prohibit such uses in Brookings city limits until December 31, 2024. On the November 5, 2024, general election ballot, voters of the city of Brookings approved that psilocybin product manufacturers and psilocybin service centers be prohibited within the city of Brookings’ jurisdictional boundaries.
