No person shall operate or use a bicycle upon any of the streets, alleys or public highways of the city of Omak without first obtaining from the Omak police department a license and registration therefor.

The police department is authorized and directed to issue, upon written application, permanent bicycle licenses which shall be effective on the first day issued and terminated upon transfer of ownership of such bicycle. Such licenses when issued shall entitle the licensee to operate such bicycle for which license has been issued, upon all the streets, alleys and public highways in the city of Omak.

The city shall provide licenses and registration cards, which licenses shall be suitable for attachment upon the frames of bicycles, and it shall be the duty of the police department to attach one such license to the frame of each bicycle and to issue a corresponding registration card to the licensee upon the payment of the license fee herein provided for. Such license shall remain attached during the existence of such license. The police department shall also keep a record of the date of issue of each license, to whom issued and the number thereof.

All persons engaged in the business of buying second-hand bicycles are required to make immediate reports to the police department, giving the name and address of the person from whom each bicycle is purchased, the description of each bicycle purchased and the frame number thereof; the number of the license found thereon, if any. All persons engaged in the business of selling new or secondhand bicycles are required to make an immediate report to the police department, giving a list of all sales made by such dealers, which list shall include the name and address of each person to whom sold, the kind of bicycle sold, together with a description and frame number thereof, and the number of the license attached thereto, if any.

It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale of transfer by returning to the police department the registration card issued to such person as licensee thereof, together with the name and address of the person to whom such bicycle was sold or transferred, and such report shall be made within five days of the date of such sale or transfer. If the purchaser or transferee is a resident of the city of Omak or intends to operate such bicycle upon the streets, alleys or public highways within the city, such purchaser or transferee shall apply to the police department of the city of Omak for a transfer of registration therefor within five days of such purchase or transfer.

No person shall wilfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame license pursuant to this chapter, or remove, destroy, mutilate or alter any license, seal or registration card during the time in which such license, seal or registration card is operative; provided, however, that nothing in this chapter shall prohibit the police department from stamping numbers on the frames of bicycles on which no serial numbers can be found, or on which said numbers are illegible or insufficient for identification purposes.

The permanent license fee to be paid for each bicycle shall be set by resolution and shall be paid in advance; and pursuant to Section 12.08.050, such license may be transferred when the ownership of such bicycle is transferred, and a fee set by resolution shall be paid for the registration of such transfer.

Any person riding a bicycle on any of the streets, alleys or public highways within the city of Omak shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle as provided by the traffic code of the state of Washington and of the city of Omak codified in Title 12 of this code, except as to those provisions of such Title 12 which by their nature can have no application.

Failure to perform any act required or the performance of any act prohibited by this chapter is designated a civil infraction and shall not be classified as a criminal offense. Any person, firm or corporation found to have committed such a civil infraction shall be subject to the penalties as set forth in Chapter 1.16. In addition to such civil penalty, the police department or any of the members thereof may impound and retain possession of any bicycle operated in violation of any of the provisions of this chapter and retain possession of the same until the license provided for herein is obtained by the owner of such bicycle.
