Editor's note–Former division 6 pertaining to the Public Works Commission, was repealed by Ordinance 2025-O-031 adopted 9/24/2025. Prior to the deletion this division derived from Ordinance 22-O-09.22-01 adopted 9/22/2022.
The city hereby creates and establishes the Capital Improvements Advisory Committee (CIAC), which is to serve as an advisory committee to the city council in accordance with Texas Local Government Code Chapter 395. The committee shall advise and assist the city council in the adoption of land use assumptions and the adoption and implementation of the city's capital improvements plan and impact fees. The members shall serve at the pleasure of the city council.

The committee shall be composed of five members appointed by a majority vote of the city council. In accordance with state law, not less than 50 percent of the membership of the committee, at least three (3) members, shall be representatives of the real estate, development, or building industries who are not city employees or officials. Membership shall include at least two (2) members from inside the city limits and at least one (1) member shall be a representative from the extraterritorial jurisdiction of the city. The terms of office shall be two years.

The committee shall perform those duties as set forth in Texas Local Government Code Section 395.058, as amended, including:
(1) 
Advising and assisting the city in adopting land use assumptions; reviewing the capital improvements plan and filing written comments; and
(2) 
Monitoring and evaluating implementation of the capital improvements plan; and
(3) 
Filing semiannual reports to city council regarding the progress of the plan and any perceived inequities in the impact fees; and
(4) 
Advising the city of the need to update or revise land use assumptions, the capital improvements plan, or impact fees.

If for any reason any member of the committee is unable to act, resigns from the member's position, becomes disqualified, or is removed from office, then the appointment of a successor to fill the unexpired term of that committee member shall be made by the city council in a manner that maintains the statutory industry and extraterritorial jurisdiction representations.

The city council will appoint the chair of the committee. The committee shall elect from its membership a vice chair. The chair shall serve as chair of the committee and run each meeting. The vice chair shall serve when the chairman is unable to perform the chair's duties. City staff shall keep a full record of the proceedings and such other records as required.

The committee shall meet as necessary to perform its statutory duties, but the committee shall have at least one regular meeting each calendar year. The committee shall file its written comments on any proposed impact fees or amendments before the fifth (5th) business day before the date of the public hearing on the imposition or amendment of the fees. All meetings of the committee shall be conducted in compliance with the Texas Open Meetings Act.
