There is hereby established a Department of Community Development in and for the Township of Lacey, and the position of Director of the Department of Community Development.
The Department of Community Development shall:
A. 
Conduct field inspections and special investigations to ensure compliance with various municipal ordinances.
B. 
Initiate and enforce rules and regulations in relation to enforcement of ordinances.
C. 
Initiate necessary legal action against violators of various municipal ordinances.
D. 
Prepare needed reports, establish and maintain records and files and assist in the promulgation of municipal ordinances.
E. 
Enforce the zoning ordinances of the Township of Lacey.
F. 
Issue zoning permits in accordance with Chapter 335, Zoning, of the Code of the Township of Lacey.
G. 
Issue flood hazard letters in writing, when requested.
H. 
Answer all inquiries with regard to zoning.
I. 
Keep a record for all applications for permits and of all permits and certificates issued with a notation of all special conditions involved.
J. 
File and safely keep copies of all plans submitted.
K. 
Collect and record fees for zoning permits and flood letter.
L. 
Prepare monthly reports for the Township Committee summarizing all zoning permits and flood hazard letters issued by said Department, a copy of which shall also be given to the Tax Assessor.
M. 
In general, perform all duties in accordance with Chapter 335 of the Code of the Township of Lacey.
N. 
Accept applications to the Planning Board, including plots, maps and other documents and instruments as required by law for consideration by the Planning Board.
O. 
Accept application fees and any other fees payable to the Planning Board as required by law.
P. 
Act as the administrative officer of the Planning Board as defined in N.J.S.A. 40:55D-3 and to issue certifications on behalf of the Township of Lacey in accordance with N.J.S.A. 40:55D-56.
Q. 
Coordinate efforts of the Planning Board of the Township of Lacey and in general to undertake such other duties or responsibilities as may from time to time be imposed with regard to the Planning Board.[1]

R. 
Maintain the official Township of Lacey House Numbering Map and, in pursuance thereof, to assign and record official numbers to lots and subdivisions and resubdivisions of land and to assign house numbers to buildings or structures. The Department shall also have responsibility to ensure that the house number assigned to each house, building or structure is properly displayed and to issue violations to occupants or owners of any dwelling not in compliance with the numbering ordinance.
S. 
Administer excavation and soil mining applications and permits, including approval and issuance thereof, field inspections and appropriate enforcement measures.

A. 
Appointment and term of office. The executive and responsible officer of the Department of Community Development of the Township of Lacey shall be known and designated as the "Director of the Department of Community Development," who shall be appointed by the Township Committee. The term of said office shall be one (1) year, commencing with January 1 of each year or until his successor is appointed. Should the office become vacant during any term, it shall be filled by a similar appointment but for the unexpired term only.
B. 
Powers. The Director shall have full charge and management of the Department and of the other officers and employees in said Department subject to the Civil Service Law[1] and to the legislative power of the municipality. Such charge shall include the power to hire, fire, discipline and promote employees within the Department of Community Development, subject to law.

C. 
Records and books. The Director shall keep accurate records and books of accounts of all transactions as Director and of the work and transactions of his Department. He shall prepare budget recommendations for the Department and shall have full charge and management of the functions of the Department of Community Development.
D. 
Reports and recommendations. The Director shall render to the Township Committee such reports, recommendations, drawings or other documents as may be required at regular stated intervals or on special request therefor. He shall hold himself available for consultation and advice to all municipal officials and municipal boards or commissions, and shall prepare and present to the Township Committee short- and long-range recommendations for the improvement of the township in the areas within the functions and duties of his Department.
E. 
Authority to delegate. The Director shall have the authority to delegate any of the duties set forth in § 18-2 of this chapter to any other qualified employee within his Department and shall make appropriate assignments within said Department in pursuance of this duty.
F. 
Disciplinary action, salary increases and transfers. The Director shall make a final determination as to disciplinary action with respect to any employee in addition to final determination as to the granting of scheduled salary increases and authority to approve or disapprove the transfer of employees into or out of his Department, subject only to Civil Service Laws and the legislative powers of the Township Committee.
G. 
Complete control. The Director shall have complete control over the internal policies, procedures, rules, regulations and organization of the Department, subject only to the applicable statutes and to coordinate work of his Department with other departments of the Township of Lacey.
H. 
Accountability. The Director shall be directly accountable to the Township Committee of the Township of Lacey or its designee.

A. 
The Department of Community Development shall consist of the Director, a Principal Clerk and such other positions and personnel as the Township Committee shall create or designate from time to time.
B. 
In addition, the Director of the Department of Community Development shall oversee the Building Department, Health Department, Engineering Department and the Land Use Department of the Township of Lacey.
