[HISTORY: Adopted by the Township Committee of the Township of Lacey 5-17-1974 as Ch. 15 of the 1974 Code. Amendments noted where applicable.]
The provisions of Subdivision B of Article 1 of N.J.S.A. 26:3-3 et seq. are hereby adopted in the Township of Lacey.

The local Board of Health of the Township of Lacey shall be composed of five (5) members and two (2) alternates. The alternate members shall be designated as Alternate No. 1 and Alternate No. 2.

Regular and alternate members of the local Board of Health shall be appointed by the Mayor, subject to the confirmation by affirmative vote of a majority of the members of the governing body in attendance at a regular meeting.
A. 
Three (3) of the members first appointed and confirmed shall serve for terms of three (3) years, and two (2) of the members first appointed and confirmed shall serve for terms of two (2) years. Upon the expiration of the term of each of the members first appointed, all subsequent appointments shall be for terms of three (3) years. Any appointment made to fill any vacancy occurring other than by reason of the expiration of the term of a member shall be for the period of the unexpired term only and shall be made in the same manner and by the same method as provided in § 55-3 hereof for the making of the original appointments to said Board.
B. 
The terms of alternate members shall be for two (2) years, except that the terms of the alternate members first appointed shall be for two (2) years for Alternate No. 1 and one (1) year for Alternate No. 2, so that the term of not more than one (1) alternate member shall expire in any one (1) year. A vacancy occurring otherwise than by expiration of term shall be filled by the governing body for the unexpired term only.

A. 
The Board of Health, upon appointment and confirmation of all of its members, shall, within two (2) weeks from the date thereof, hold an organizational meeting at which it shall fix a place, day and hour for the regular meeting of the Board to conduct its general business, notice of which shall be published in at least one (1) newspaper circulating in the Township of Lacey at least twice, once in each of the next two (2) consecutive weeks following the week in which said organization meeting is held. The Board shall hold at least one (1) regular meeting each month and such special meetings as may be called from time to time by the Chairman of the Board of Health or by three (3) members of said Board in accordance with such rules and regulations as said Board may adopt.

B. 
An alternate member may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member. A vote shall not be delayed in order that a regular member may vote instead of an alternate member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote first.

C. 
An alternate member shall not be permitted to act on any matter in which he or she has either directly or indirectly any personal or financial interest. An alternate member may, after public hearing if he or she requests one, be removed by the governing body for cause.

The members of the Board of Health shall receive no salary or compensation for their services.
Upon appointment and confirmation of the members of the new Board, the Township Clerk shall notify each appointee of his appointment and shall properly induct him into office. The tenure of the present Board of Health shall cease at the time of and simultaneously with the organization and qualification of the new Board as provided for herein. Upon the induction of the new members into office and after organization thereof, the new Board shall immediately assume all of the duties, obligations and responsibilities of the local Board of Health.
