Any person, firm, or corporation violating the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction of such violation, such person, firm or corporation shall be subject to punishment by a fine of not more than $ 1,000 or by imprisonment for not more than 90 days, or both such fine and imprisonment. It is unlawful for any person to discharge or use fireworks in a reckless manner which creates a substantial risk of death or serious physical injury to another person or damage to the property of another. A violation of this chapter is a gross misdemeanor. A person is guilty of a separate offense for each day during which he or she commits or continues a violation of any provision of this chapter.
