The provisions of Part II, General Legislation, of the Code of the Borough of Englishtown shall be enforced by the Code Enforcement Officer and/or the Police Department of the Borough.

A.
General penalties.
(1)
Except as otherwise specifically provided, any person who violates any provision of the Code of the Borough of Englishtown shall, upon conviction thereof, be subject to one or more of the following penalties:
(a)
A fine of not less than $100 and not exceeding $2,000;
(b)
Imprisonment in the county jail or in any place provided by the Borough for the detention of prisoners for a term not exceeding 90 days;
(c)
A period of community service not exceeding 90 days;
(d)
Any combination of the foregoing, in the discretion of the court.
(2)
Each day or portion thereof during which a violation continues shall constitute a separate and distinct offense.
B.
Repeat offenders.
(1)
Any person who is convicted of violating the same ordinance within one year of the date of a previous violation, and who was fined for such previous violation, shall be subject to an additional fine as a repeat offender.
(2)
The additional fine shall be not less than the minimum nor greater than the maximum fine prescribed for the violation of the ordinance and shall be imposed separately from, and in addition to, the penalty for the underlying violation.
D.
Collection of fines. Any fine, together with costs and charges incident thereto, may be collected and enforced in an action of debt or in such other manner as may be permitted by law.
