For brevity and ease of communication, this chapter may be cited as
the "Town of Carmel Sewer Use Law."
The general purpose of this chapter is the following: To provide for
efficient, economic, environmentally safe, and legal operation of the various
Town of Carmel publicly owned treatment works (POTW's).
The specific purposes of this chapter are the following:
A. To prevent the introduction of substances into a POTW
that will:
(1) Interfere with the POTW in any way.
(2) Pass through the POTW to the state's water and cause
contravention of standards for those waters or cause violation of the POTW's
SPDES permit.
(3) Increase the cost or otherwise hamper the disposal of
POTW sludge and/or residuals.
(4) Endanger municipal employees or, in the case of the Mahopac
Wastewater Treatment Plant, employees of NYCDEP.
(5) Cause air pollution or groundwater pollution, directly
or indirectly.
(6) Cause, directly or indirectly, any public nuisance condition.
B. To prevent new sources of infiltration and inflow and,
as much as possible, eliminate existing sources of infiltration and inflow.
C. To assure that new sewers and connections are properly
constructed.
D. To provide for equitable distribution to all users of
the POTW of all costs associated with sewage transmission, treatment, and
residuals disposal, and to provide for the collection of such costs.
The provisions in the existing Town of Carmel Code entitled "Sewerage Connections and Uses" are hereby repealed and said provisions are replaced by the herein set forth Articles
I through
XV, inclusive.
