By resolution adopted on the 16th day of October 1957, by the Board
of Trustees of the Village of Ellenville, the Planning Commission of the Village
of Ellenville has the authority to approve, modify and disapprove plats for
subdivision within the Village of Ellenville and to assume all other powers
and duties as prescribed by §§ 7-728, 7-730 and 7-732 of the
Village Law of the State of New York.
A.
It is declared to be the policy of the Village of Ellenville
Planning Commission to consider land subdivision plats as part of a plan for
the orderly, efficient and economical development of the Village. This shall
be interpreted to include the following objectives which shall guide the Planning
Commission's decisions:
(1)
Land to be subdivided shall be of such character that
it can be used safely for building purposes without danger to health or peril
from fire, flood or other menace.
(2)
Proper provision shall be made for water supply, drainage,
sewerage and other needed public improvements and utilities.
(3)
Proposed streets shall compose a convenient system conforming
to the Comprehensive Master Plan.
(4)
Streets shall be of such width, grade and location as
to accommodate present and prospective traffic.
(5)
All development shall afford adequate light and air.
(6)
All development shall facilitate adequate fire protection
and provide access for fire-fighting equipment.
(7)
Open space for parks and playgrounds shall be shown on
the subdivision plat wherever appropriate.
(8)
In case any of these regulations shall conflict or be
inconsistent with any provision of Village Law, the relevant provisions of
Village Law shall apply.
B.
In order that land subdivisions may be made in accordance
with this policy, these regulations, which shall be known and may be cited
as the "Village of Ellenville Land Subdivision Regulations" are hereby adopted.
A.
Except where specifically defined herein, all words used
in these regulations shall carry their customary meanings.
B.
Words used in the present tense shall include the future.
C.
Words used in the singular number shall include the plural,
and words used in the plural number include the singular, unless the context
clearly indicates the contrary.
D.
The word "shall" is always mandatory. The word "may"
is permissive.
E.
"Building" or "structure" includes any part thereof.
A "building" includes all other structures of every description, except fences
and walls, regardless of dissimilarity to conventional building forms.
F.
The word "lot" includes the word "plot" or "parcel."
G.
The word "person" includes a corporation as well as an
individual.
H.
The phrase "used for" includes "arranged for," "designed
for," "intended for," "maintained for" and "occupied for."

For the purpose of these regulations, certain words used
herein are defined as follows:
A street which serves or is designed to be used primarily for fast
or heavy traffic.
A street which carries traffic from minor streets to the major system
of arterial streets, including the principal entrance streets of a residential
development and streets for circulation within such a development.
The Planning Commission of the Village of Ellenville.
A street with only one means of vehicular ingress and egress and
with a turnaround at its terminus.
A low barrier, usually along the pavement line of a street, road
or highway, controlling surface drainage and separating vehicular areas from
pedestrian and/or landscaped areas.
An acquired right of use on the property of another.
The duly designated engineer of the Village of Ellenville or, in
lieu of such an official, the planning consultant or engineer employed by
or assigned to the Village Planning Commission.
A lot enclosed on all sides by other lots and not abutting a public
street.
A minor street which is parallel to and adjacent to an arterial street
and which provides access to abutting properties and protection from through
traffic.
A comprehensive plan prepared by the Planning Commission pursuant
to § 7-722 of the Village Law, which indicates the general locations
recommended for the various functional classes of public works, places and
structures and for the general physical development of the Village of Ellenville
and includes any unit or part of such plan separately adopted and any amendment
to such plan or parts thereof.
A street intended to serve primarily as access to abutting properties.
Considered to be the date of the first regular meeting of the Planning
Commission following the date on which plats, surveys, plans, documents and/or
applications are first filed with the Village Clerk.
The final map, drawing or chart on which the subdivider's plan
of subdivision is presented to the Planning Commission for approval and which,
if approved, will be submitted to the County Clerk for recording.
A preliminary drawing showing the proposed layout of a subdivision
which is submitted to the Planning Commission for its consideration and preliminary
approval.
A freehand sketch made on a topographic survey map showing the layout
of streets, lots and other features of a proposed subdivision in relation
to existing conditions.
A way for vehicular traffic, whether designated as a street, highway,
thoroughfare, parkway, throughway, road, avenue, boulevard, lane, place or
however otherwise designated.
An intersection of two streets in which one street, upon entering
the second street, does not continue straight across the second street as
follows: the center line of one street, in order to continue the angle at
which it enters each side of the second street to the center line of said
second street must follow the center line of such second street before continuing
across the intersection, thereby describing an offset of the first street's
center line.

The wearing or exposed surface of the roadway used by vehicular traffic.
The width of the right-of-way or the distance between property lines
on opposite sides of a street.
Any person, firm, corporation, partnership or association which shall
lay out, for the purpose of development and/or sale, any subdivision, as defined
herein, either for himself, itself or for others.
Any parcel of land which is divided into two or more lots, plots,
sites or other divisions, with or without streets, for immediate or future
sale or for building development. The division of a parcel within an established
subdivision plat or the redesign of any plat shall be considered a new "subdivision."
