Except as otherwise specifically set forth in
this chapter, the parking of vehicles is hereby prohibited on all
highways and streets within the Village, which are maintained by the
Village, at any time between the hours of 9:00 p.m. and 7:00 a.m.,
commencing November 14 and ending on April 1 of each year.
The Village Board has determined that overnight parking in village-owned or -maintained parking lots must be restricted to permit proper maintenance and snow removal. Moreover, the Village Board recognizes the shortage of off-street parking in certain districts of the village and, in particular, the business districts. In an effort to accommodate each of these concerns, the Village Board has determined that parking in village-owned or -maintained parking lots between the hours of 3:00 a.m. and 7:00 a.m. during the period beginning November 15 and ending April 1 of each year shall be prohibited, except as provided in this Article
IV of this Chapter
217. The Village Board has further determined that parking in village-owned or -maintained parking lots between the hours of 9:00 p.m. and 7:00 a.m. the following day during the period beginning November 15 and ending April 1 of each year shall be permitted only if the vehicle owner has obtained a parking permit from the village in accordance with the provisions of §§
217-29 and
217-30 of this chapter.
Any vehicle owner desiring to park his vehicle
in a parking lot owned or maintained by the village during the hours
from 9:00 p.m. through 7:00 a.m. the following day during the period
beginning November 15 and ending April 1 of any year shall apply for
a permit from the Village Clerk, and if a permit is so issued by the
Village Clerk, such vehicle owner may park his vehicle in the parking
lot designated by the Village Clerk at the time the permit is issued
during the aforesaid hours.
An application for the permit required pursuant to §
217-29 shall be filed with the Village Clerk, in writing, and shall contain the following information:
A. The name of the vehicle owner.
B. Information concerning the vehicle for which the permit
is required, including the license number, the registration number,
the name of the person who has title to the vehicle, the insurance
company which insures the vehicle and the insurance identification
number.
C. A statement of the reasons why the vehicle owner requires
a permit. For purposes of this requirement, the applicant must demonstrate
that the applicant lives within two blocks of the parking lot for
which the applicant seeks a permit and that the applicant's residence
does not provide sufficient parking for the applicant.
D. The village parking lot for which the permit is sought.
The Village Board shall be authorized to designate which parking lots within the village shall be designated for permit parking and which sections of each said parking lot shall be available for permit parking and the number of parking spaces in each such section for which permit parking may be available. Permits for each parking lot that the Village Board designates shall be issued on a first-come-first-served basis, based upon those persons who demonstrate the applicable need, as provided in §
217-30C of this chapter.
Any vehicle owner who is denied a permit for
any reason, other than the reason that there are no remaining permits
available for the designated parking lot, may appeal the determination
to the Village Board. Any such appeal shall be heard within 30 days
after the appeal has been submitted to the Village Manager.
Any permit issued pursuant to this chapter will
designate the parking lot for which the permit is valid. Such permit
shall be valid for the period beginning November 15 and ending April
1 or the period, or part thereof, for which it is issued.
A permit shall be valid only for the person
to whom the permit has been issued and only for the vehicle for which
it has been issued. In no event may a permit be assigned, subleased,
licensed or otherwise transferred, and any attempted violation of
the foregoing shall result in an immediate revocation of the permit
in question. For purposes of this section, a permit holder may replace
a vehicle for which a permit has been issued with a different vehicle,
provided that the requirements of this chapter are satisfied with
respect to the replacement vehicle and provided that notice of replacement
is provided to the Village Clerk.
Each person to whom a permit is issued shall
pay a fee of $25 for each permit issued to such person. Said sum shall
be paid upon application thereof and shall be deposited in the general
fund of the village. In the event that the applicant is denied a permit,
the fee which has been paid to the village will be refunded to such
person.
