The New York State Uniform Fire Prevention and Building Code shall be applicable in the Village of Great Neck Estates. No building or structure shall be constructed, altered, installed, repaired or removed, except in conformity with the provisions of the New York State Uniform Fire Prevention and Building Code, and the applicable provisions of the Code of the Village of Great Neck Estates.
A. 
Unless otherwise expressly stated, the following terms shall, for the purposes of this code, have the meanings herein indicated:
ALTERATION
As applied to any building or structure, is any change or rearrangement in the structural parts or in the exit facilities or any enlargement, whether by extending on any side or by increasing in height, or the moving from one location or position to another.
APPROVED
As applied to any material, device or mode of construction, means approved by the Board of Trustees, which approval will be given only after satisfactory evidence of impartial tests is submitted to the Board.
CURB
When used in defining the height of a building, means the curb level as established by the Board of Trustees at that point of the curb which is opposite the center of the wall nearest to and facing the street line. The term "curb," when used in fixing the depth of an excavation, means the curb level as established by the Board of Trustees at that point of the curb which is nearest to the point of the excavation in question.
GARAGE
A building, shed or enclosure, or any portion thereof, in which a motor vehicle containing volatile flammable oil in its fuel storage tank is stored, housed or kept.
HEIGHT
As applied to a building or structure, the vertical distance, measured in a straight line from the curb level to the highest point of the roof beams in the case of flat roofs and to the average height of the gable in the case of roofs having a pitch.
OCCUPIED
As applied to any building, shall be construed as though followed by the words "or intended, arranged or designed to be occupied."
OWNER
Includes his duly authorized agent or attorney, a purchaser, devisee and any person entitled to an interest in the property in question.
STORY
That part of any building comprised between any floor and the floor or roof next above.
B. 
Any term not defined herein but defined in other ordinances of the Village shall be construed for the purpose of this code as so defined.
C. 
For the purpose of this chapter, and for the purpose of the Building Code and the Plumbing Code of the Village, the words "building" and "structure" shall include any trailer, house coach, car or vehicle used or intended to be used within the Village for dwelling purposes or for the sale or display of goods, wares and merchandise or for any purpose whatsoever other than the transportation of persons or property, except machinery temporarily used in connection with building operations or the alteration of the premises on which they are located or operated.

A. 
The administration of the laws and regulations applicable with respect to building and construction in the Village of Great Neck Estates shall be conducted by the Building Inspector, except where otherwise provided in this Code.
B. 
The Building Inspector shall be appointed by the Mayor, with the approval of the Board of Trustees, and shall serve at the pleasure of the Mayor. The Building Inspector shall conduct and supervise the operation of the Building Department, if any, and administer and enforce the provisions of the Code of the Village of Great Neck Estates. The Building Inspector shall have authority to issue violation notices, summonses and appearance tickets for the purposes of such enforcement to the maximum extent permitted by law.
(1) 
Any person appointed to the position of Building Inspector shall be familiar with the provisions of this Code and the provisions of the New York State Uniform Fire Prevention and Building Code, and shall be generally informed on the quality and strength of building materials, on the prevailing methods of building construction, on good practice in fire prevention, on the accepted requirements for safe exit facilities and on the proper installation of plumbing, electrical wiring and other installation for the safety, comfort and convenience of occupants of buildings. Such person shall be in good health sufficient to permit such person to perform the physical duties of the position, including the necessary examinations and inspections of buildings in the course of construction. In addition to any other limitations provided by law, the Building Inspector shall not have any interest whatever, directly or indirectly, in the sale or manufacture of any material, process or device entering into or used in or in connection with building construction.
(2) 
With the consent of the Board of Trustees, the Mayor may appoint such assistants to the Building Inspector as may be deemed necessary for the enforcement of the provisions of the Code of the Village of Great Neck Estates.
C. 
It shall be the duty of the Building Inspector, and such other persons as may be designated to act on behalf of the Building Inspector, to enforce the provisions of this chapter. In the discharge of such duties, the Building Inspector shall have authority to enter any building or premises at any reasonable time, as may be authorized by law.
D. 
An application for a permit or certificate of occupancy shall constitute the consent of the owner of the subject property that the Building Inspector or such other persons as may be designated to act on behalf of the Building Inspector may enter upon such property, and inspect the same, during the course of the construction work on such property and until the issuance of a certificate of occupancy or certificate of completion for the completed work.
