Plans. Plans for new construction shall show the location
of the driveway, if any, and the grade thereof.
B.Â
Grade. No driveway constructed or intended to be constructed
at an elevation higher than the street which it intersects shall have
a grade of more than 10% between its intersection with the pavement
of such streets and a point on the driveway 25 feet distant therefrom.
Every driveway now existing which fails to comply with the requirements of § 95-16B shall be reconstructed and/or relocated so as to comply with such section on or before January 1, 1960.
If the Board of Trustees, upon application by
the property owner concerned, should determine in a particular case
that it is impossible or impracticable to comply with the requirements
of this article, or that there would be extreme difficulty or hardship
in so doing, the Board of Trustees may fix other requirements for
such driveway which will, in its opinion, promote safety and avoid
danger to persons using the public street.
