The regulations contained in this chapter are adopted for the
care, management and protection of the Village park, for the regulation
of conduct of persons within such park and the exclusion of improper
persons therefrom. In furtherance thereof, the Board of Trustees is
authorized to adopt, and from time to time amend, rules and regulations
for the use of the Village park and pool, which regulations may pertain
to matters included in this chapter or otherwise. If such rules and
regulations conflict with any provision of this chapter, the provisions
of such rules and regulations shall take precedence over the provisions
of this chapter.
A.Â
The use of the park and its facilities is limited to residents of
the Village of Great Neck Estates, their guests as provided in this
chapter and the rules and regulations, and such other persons as may
be authorized pursuant to this chapter.
B.Â
The Board of Trustees may, by resolution, define the term "resident"
for the purposes of this article and establish categories of residency
and fees for use of the park and its facilities by persons in such
categories. The Board of Trustees also may adopt regulations, including
fee requirements, for the admission of guests and other persons to
the park and its facilities; provided, however, that in no event shall
guests be permitted admission to the park and its facilities unless
accompanied by one or more resident sponsors.
C.Â
Park admission cards will be issued by the Village Clerk to persons
eligible therefor upon application. Persons desiring admission to
the park or its facilities, or using the park or such facilities,
shall identify themselves by showing their admission cards and furnishing
other pertinent information upon request of the park attendants.
D.Â
No person shall use or be within the boundaries of the park or its
facilities unless such person is an authorized resident or guest or
unless such use or presence is otherwise authorized by the Board of
Trustees.

Pursuant to § 150-2B of this Code, and for the purposes of this chapter, the term "resident" shall mean:
A.Â
An adult taxpayer who lawfully resides in the Village;
B.Â
Each adult who is a member of the household of such adult taxpayer
and who lawfully resides in the Village; and
C.Â
A minor who is a member of the household of such adult taxpayer and
who lawfully resides in the Village or is a full-time student in an
accredited course of study leading to a degree.
Unless otherwise determined in rules and regulations adopted
or amended from time to time by resolution of the Board of Trustees,
the park will be open from 7:00 a.m. until 10:00 p.m. beginning on
Memorial Day and ending on Labor Day in each year. The park will be
open at all other times from 8:00 a.m. to sundown and closed to the
public at other hours. No person shall be permitted in the park during
hours when the park is closed to public use.
No person shall enter or leave the park premises except at the
entrances established for such purposes.
Residents shall be responsible for the conduct of their guests.
A.Â
No person shall use the tennis courts at any time during which the
Park Superintendent determines that the condition of the courts does
not permit playing.
B.Â
All players using the tennis courts must wear rubber-soled tennis
shoes without heels.
C.Â
The Board of Trustees, by resolution, may enact reasonable rules
and regulations for the use of the tennis courts, including the establishment
or amendment of fees for such use.
D.Â
Children under 16 should defer to adults in the use of the courts.
E.Â
All men must wear outer shirts while on the tennis courts.
A.Â
All persons using dock and float facilities do so at their own risk.
No person may use the dock or float facilities unless such person
is a resident boat owner who holds a locker permit, or an authorized
guest of such boat owner.
B.Â
The west side of all floats shall be reserved for loading and unloading
of boats only, and the maximum time for said loading and unloading
shall be 15 minutes.
No bathing shall be permitted in the waters of Little Neck Bay
fronting the park unless such waters have been pronounced fit for
bathing by the Nassau County Department of Health.
A.Â
No person on the park premises shall engage in disorderly or intoxicated
conduct. No person shall bring any alcoholic beverage into the park
premises or possess, consume, sell or otherwise provide any alcoholic
beverage in the park.
B.Â
No person shall utilize profane, obscene, insulting or abusive language
in the park.
C.Â
No person shall commit any disorderly or noisy conduct or obscene
or indecent acts tending toward a breach of the peace.
D.Â
No disrobing is permitted in toilets.
E.Â
No person shall mutilate, deface or otherwise damage or remove any
park property.
F.Â
No person shall cut, pull or remove any flowers, shrubbery or trees
from the park or' in any way damage any of the shrubbery or gardens.
G.Â
No person shall throw or deposit any wastepaper, newspaper, boxes
or rubbish of any kind upon park grounds.
H.Â
Rubbish and refuse must be deposited in receptacles provided for
such purpose.
The park is not a public forum. No public meeting or gathering
may be held within the park premises without the prior written consent
of the Board of Trustees.
No person shall within the park:
A.Â
No motor vehicle shall be permitted to park stop or stand at any
place in the park except at the parking area designated for that purpose,
and then only for a period of time authorized by law, rule or regulation.
B.Â
Except as otherwise permitted pursuant to the park rules and regulations
adopted pursuant to this chapter, no motor vehicle shall be parked
at any location in the park unless it displays a current parking sticker
or valid visitor pass issued by the Village of Great Neck Estates
as required by such rules and regulations.
C.Â
No motor vehicle shall be operated in the park at a speed in excess
of 10 miles per hour.
A.Â
Any person found to have violated any provision of this chapter, or of any rule or regulation adopted or promulgated pursuant to this chapter, shall be guilty of a violation and shall be punishable in the manner provided in § 1-1 of this Code.
B.Â
In addition to any other punishment or penalty provided by law, the
Mayor, or the Board of Trustees, or the Village Justice Court, may
exclude from the use and privilege of the park for a period of time
determined by such official(s), but not to exceed one year, any person
who violates any provision of this chapter or any rule or regulation
adopted or promulgated pursuant to this chapter.
The Village of Great Neck Estates shall not be responsible for
any article of property lost or stolen on the park premises.
The Board of Trustees reserves the right within its discretion
to modify these rules and adopt such new rules, from time to time,
by local law or by resolution as it may deem advisable.
The regulations herein, and other regulations as may be adopted
or amended by the Board of Trustees from time to time, are for the
care, management and protection of the Village swimming pool and the
locker building and grounds appertaining thereto and for the conduct
of persons within such area and the exclusion of improper persons
therefrom.
The normal operating season for the pool shall be from Memorial
Day to the Monday following Labor Day, but the time of opening or
closing for the season may be varied in the discretion of the Board
of Trustees.
Weather permitting, the pool shall be open for admission from
10:00 a.m. until 7:30 p.m. each day. No person may remain in the pool
or pool area between 8:00 p.m. of any day and 10:00 a.m. of the following
day, except as authorized by the Village.
Between 10:00 a.m. and 11:00 a.m., except on Saturdays, Sundays and holidays, children under the age of 14 shall, subject to the safety regulations hereinafter set forth in § 150-27, have the exclusive use of the pool for the purpose of receiving swimming instructions from pool lifeguards upon payment of fees as hereinafter set forth in § 150-25. Such instructions will not be permitted at other times.
Residents of Great Neck Estates, hereinafter for convenience called "residents," shall have the right to use the pool only on the basis of unlimited seasonal use, the fees for which shall be established from time to time pursuant to § 150-25. A signed duplicate identification card will be issued, at the time of the payment of the fee, to each member of the immediate family of each resident, the duplicate to be retained by the pool management. Such card will set forth the name, sex and age of the holder and shall be signed by each holder over the age of eight years. Residents shall, at the time of each entry into the pool area, show their identification card and shall, upon request of the pool attendant at the entrance desk, also sign a registry book which shall be kept for the purpose at the desk at the entrance to the pool.
A.Â
Guests of residents may, subject to the payment of appropriate fees
by the resident, be permitted the use of the pool if accompanied by
an adult member of the resident host's family. All guests shall,
at the time of each entry to the pool area, sign the registry book
that shall be kept at the desk at the entrance to the pool.
B.Â
For each resident host family, the number of guests permitted to
use the pool on any day is limited to two adult guests and the children
of such adult guests.
C.Â
The same guest shall not be permitted the use of the pool more than
twice a month as a guest of any one or more resident families.
D.Â
Resident families may secure, for not exceeding two houseguests at
one time, a weekly card permitting such houseguest to use the pool
for a continuous maximum period of one week in a season. Such houseguest
shall be permitted the use of the pool on Saturdays, Sundays and holidays
as well as other days in the week covered by the card.
The Board of Trustees, by resolution, may enact reasonable rules
and regulations for the use of the pool, including the establishment
or amendment of fees for such use.
A.Â
Every person using the pool is required to be familiar with and to
obey the rules promulgated by the State of New York covering the use
of pools. A copy of such rules will be posted at the entrance of the
pool, and an extract of such rules will be distributed at the beginning
of each season to each family registering for seasonal use of the
pool.
B.Â
Attention is called to the fact that these rules require every person
to take an adequate shower bath before entering the pool.
C.Â
Care must be used to see that any refuse is placed in receptacles
provided for that purpose.
D.Â
Dogs and other animals are not permitted within the pool area.
E.Â
Consumption of food is strictly forbidden in the pool area.
A.Â
No glass containers of any kind are permitted within the pool area.
B.Â
At all times, children under the age of eight years must be accompanied
in the pool or pool area by an adult entitled to enter the pool as
a resident or guest. Children of eight years and over shall be permitted
in the pool unaccompanied by such an adult only upon evidence of ability
to swim.
C.Â
No games of any kind, including card playing, shall be permitted
within the pool area, and no toys or athletic equipment other than
inflated rubber toys are permitted within the pool area.
A.Â
Cars in the vicinity of the pool shall be parked only in the designated
parking area.
B.Â
No person is permitted to dress or disrobe anywhere in the pool area
except in the locker room provided for that purpose.
C.Â
The lifeguards, caretaker and other employees of the pool and pool
area have the authority to interpret and enforce these rules and regulations,
and residents and guests are subject to such interpretation.
D.Â
Anyone violating any of these rules may be barred from use of the
pool, in addition to any other penalties provided by law for violation
of the Village Code or park and pool regulations.
Any identification card tendered for the purpose of admission
to the pool or otherwise used by a person who is not the holder named
therein will be picked up by the pool attendant and turned in at the
Village office, where it will be retained pending action by the Board
of Trustees. In any such case, the Board of Trustees may cancel the
identification card and revoke the permission granted to the holder
to use the pool, without refund of the fee previously paid.
Every person present at the park, swimming pool, locker building, grounds or other area to which the regulations stated in Article I may relate shall comply with any order or direction of the person then in charge of such area, who is hereby authorized to require any person whom he/she may deem to be violating any of said regulations to leave such area and thereafter, subject to the approval of the Board of Trustees, to exclude such person therefrom.
