A. 
No container, dumpster, receptacle or other object for the collection of rubbish or debris (hereinafter referred to in this article as “container”) having a capacity in excess of five cubic yards shall be located or maintained outdoors on any private property in the Village without a permit for the same first having been issued. Such permits shall be issued by the Code Official, upon written application therefor, and each such permit shall be valid for a period of 14 days. Such permits may be renewed by the Code Official for not more than three additional periods of 14 days each, upon written application. Further renewals of such permits may be issued by the Board of Trustees upon written application, and subject to reasonable conditions. All such applications shall be accompanied by payment of a fee in an amount determined by resolution of the Board of Trustees.
B. 
No container shall be placed upon any public property in the Village, including any street or sidewalk, without a permit for the same first having been issued by the Code Official, except that containers placed in such locations by the Village shall not require a permit. All applications for such permits shall include payment of a fee in an amount determined by resolution of the Board of Trustees.
C. 
Notwithstanding the foregoing, a container having a capacity in excess of five cubic yards may be maintained outdoors on any private property in the Village when necessary in conjunction with construction activity being performed pursuant to a valid building permit, and provided that a permit has been issued for such container. Such permits shall be issued by the Code Official upon written application therefor, and shall be valid for a period of 60 days. Such permits may be renewed by the Code Official for not more than two additional periods of 60 days each, upon written application. Further renewals of such permits may be issued by the Board of Trustees upon written application, and subject to reasonable conditions. All such applications shall be accompanied by payment of a fee in an amount determined by resolution of the Board of Trustees.
A. 
Any person desiring a permit under this article shall make written application therefor to the Code Official, specifying the exact proposed location of such dumpster, container or other receptacle, the size and capacity thereof, the name of the owner of the abutting property, the length of time that said use is required and any other information as may be required by the Code Official.
B. 
Any permit issued pursuant to this article for location of a container on public property shall be valid only for 48 hours, unless the duration of the permit is otherwise specified in writing on the permit by the Code Official. In no event shall any such permit be valid for more than 30 days.
C. 
All such dumpsters, containers or receptacles permitted pursuant to this article shall bear an identification number assigned by the Village, and the name, address and telephone number of the person responsible therefor shall be prominently displayed thereon.
D. 
All such dumpsters, containers or receptacles which remain in place during any of the hours between sunset of one day and sunrise of the next day shall be equipped with suitable reflectors and barricaded with flashing lights or other warning or protective devices as may be required by the Code Official in order to avoid a hazard to vehicular or pedestrian traffic. Any such reflectors shall be capable of reflecting motor vehicle headlights at a distance of at least 500 feet.
Prior to and during the location or installation of any dumpster, receptacle or container hereunder, the applicant must demonstrate compliance with the applicable provisions of the Village Code and must comply with the following standards:
A. 
The applicant must produce a certificate of liability insurance, naming the Village as an additional insured, in an amount to be determined by the Code Official, but not less than single limits of $500,000.
B. 
A separate permit must be requested and obtained for each dumpster, receptacle or container proposed to be located on a street, sidewalk or public property.
C. 
No dumpster, receptacle or container may exceed 30 cubic yards of capacity.

D. 
Any dumpster, receptacle or container which contains animal or vegetable refuse shall be kept covered at all times with a metal cover or other suitable covering approved by the Code Official.
E. 
No dumpster, receptacle or container may be placed within 25 feet of any intersection or in any location not approved by the Code Official.
A. 
The Code Official may, in his discretion, refuse to issue a permit if he deems the same to constitute a danger to public safety or an unwarranted interference with the efficient movement of vehicular or pedestrian traffic.
B. 
The Code Official may revoke a permit for the same reasons as he may refuse issuance of a permit or for violation of the provisions of this article, and if the dumpster, receptacle or other container is not removed within 24 hours after notification of such revocation, the same may be removed by the Village and stored at the owner's expense.
C. 
If the Code Official shall determine at any time that an emergency situation exists with respect to a dumpster, receptacle or other container, he may cause the same to be removed and stored at the expense of the owner.
Any appeal from the refusal of the Code Official to issue a permit hereunder or the revocation of a permit hereunder or from the imposition of any condition hereunder shall be made in writing to the Board of Trustees within 30 days of the determination by the Code Official. The pendency of any such appeal shall not affect the efficacy of the determination appealed from.
The provisions of this article shall not apply to containers or receptacles used for normal residential garbage collections nor to bundled newspapers which have been placed by the curb for pickup.

A. 
No person being the owner or occupant of property shall cause, suffer or permit any tree, any structure, other object, or any condition to be maintained on such property in such manner as to cause a hazard or danger of injury to persons or property, or to cause a hazard or danger to utility or communications lines, poles, pipes, or other equipment.
B. 
In any case where the Code Official determines that a violation of Subsection A hereof exists on any property in the Village, the Code Official may issue a remediation notice to the owner and/or occupant of the property on which such condition exists, directing such owner and/or occupant to take remedial action of a type and within the time specified in such notice.
C. 
The Code Official may also provide a copy of such notice to the owner and/or occupant of any property adjoining the property on which the dangerous condition is claimed to exist, for the purposes of informing such owner and/or occupant that the dangerous condition exists on adjoining property.
D. 
Any owner or occupant of property who receives notice to remediate a dangerous condition as provided in Subsection B hereof, and who fails to remediate the dangerous condition within the time period and as directed in such notice, or at such other time or in such other manner as may be approved by the Code Official, shall be guilty of an offense. Upon conviction of any such offense, such person shall be subject to penalties as provided in this Code.
