Before the first day of October in each year,
the Commissioner of Public Works shall prepare a proposed scale of
water use charges or rents to be paid by any person, firm or corporation
being served by or using water from the Hudson Water Supply, which
said charges shall be applicable to all users of said system during
the ensuing fiscal year.
The Commissioner of Public Works shall immediately
transmit the proposed water rents, together with the proposed budget
for the operation of the City water system during the ensuing fiscal
year, to the Board of Estimate and Apportionment, which shall have
the power to approve or modify such proposed water rents. The Board
of Estimate and Apportionment shall forthwith present the proposed
water rents to the Common Council, which shall have the final power
and authority to accept or reduce, but not to increase, the water
rents authorized by the Board of Estimate and Apportionment as aforesaid.

The water use charges or rents as finally adopted
by the Common Council shall be applicable to and imposed upon all
users of the City water system for the fiscal year, commencing May
1 of each year. Said water rents shall be charged on a quarterly basis
and shall be due and payable on the 30th day of April, July, October
and January. Interest at the rate of 1 1/2% per month shall be
charged on all water bills not paid within 30 days of the due date.
Water rents shall constitute a lien upon the
real property served by said water system. The lien shall be prior
and superior to any other lien or claim, except the lien of an existing
tax, assessment or other lawful charge imposed by or for the State
of New York or the City of Hudson.

The Commissioner of Public Works shall annually
cause a statement to be prepared, setting forth the amount of each
lien for water rents in arrears, the real property affected thereby
and the name of the person, firm or corporation in whose name such
real property is assessed. Such statement shall be presented to the
Common Council on or before the first day of December in each year,
and said Common Council shall levy the amounts contained in such statement
against the real property liable on the first day of January in each
year, and such amounts shall be set forth in a separate column in
the annual tax rolls. The amount so levied shall be collected in the
same manner and at the same time as may be provided by law for the
collection and enforcement of City taxes.
Revenues derived from water rents, including
penalties and interest; shall be credited to a special fund, to be
known as the "Water Rent Fund." Moneys in such fund shall be used
in the following order:
A. For the payment of the cost of operation, maintenance
and repairs of the water system.
B. For the payment of the interest on and amortization
of, or payment of, indebtedness which has been or shall be incurred
for the construction of the water system.
C. For the construction of the water system with the
necessary appurtenances, including pumping facilities, or for extension,
enlargement or replacement of or additions to such water system.
