The building inspection includes the common areas, heater/mechanical

Subject properties and amount of capacity.

(a)
|
Properties subject to payment of a tapping fee:
| |||||

A tapping fee must be paid regarding all allocations of capacity
for immediate use and all allocations reserved for future use. A tapping
fee must be paid in regard to all structures or wastewater generating
uses which after the date of this ordinance are connected in any manner
to the Lower Moreland system. A tapping fee will be required regarding
all properties which have been connected and which after the date
of this ordinance increase their sewer usage in any manner, whether
by subdivision, construction of additional buildings or facilities,
physical change or expansion of structures, change of use, or in any
other manner. A tapping fee will be required regarding any property
or use to the extent the volume of wastewater being deposited into
the Lower Moreland system in the future from such property exceeds
the capacity previously allocated for such property or use.

In the event any applicant or property owner asserts that an
allocation of capacity has been made for any property or use before
the adoption of this ordinance such that no tapping fee under this
ordinance needs to be paid, the burden shall be on such owner or applicant
to substantiate the amount of any prior allocation of capacity.

No tapping fee shall be imposed or required regarding any use
which the Township or the Lower Moreland Township Authority ("the
Authority") has agreed in writing to permit to be connected without
the imposition of a tapping fee, provided the owner of the property
to which such capacity allocation relates is in compliance with all
agreements with this Township and all agreements with the Authority. | |||||
(b)
|
Amount of capacity that must be acquired. The amount of the
tapping fee required shall be based upon the capacity required, which
capacity shall be determined in the following manner.

For residential uses, a capacity of 253 gallons per day ("GPD")
of capacity shall be required for each individual single-family residence,
each part of a duplex, each apartment unit, each townhouse unit, each
condominium unit, and any other form or type of dwelling unit which
is suitable for occupancy by one family unit. For residential uses,
the 253 GPD of capacity that must be secured for each single-family
residence, each part of a duplex, each apartment unit, each townhouse
unit, each condominium unit, and any other form or type of dwelling
unit which is suitable for occupancy by one family unit shall be referred
to as an "equivalent dwelling unit" or as an "EDU." Such capacity
of 253 GPD per EDU is based upon:

90 gallons per person per day; and
| |||||
[b]
|
The "average number of persons per household" in the Township
as established by the most recently issued census data provided by
the United States Census as of the date this ordinance is adopted.
If the "average number of persons per household" in the Township as
established by census data provided by the United States Census changes
after the date of the adoption of this ordinance, the capacity required
to be purchased for any residential unit shall be adjusted accordingly.

For all nonresidential uses and buildings, the tapping fee shall
be based upon the number of gallons per day ("GPD") of capacity needed
for such use or building. The determination of the number of gallons
per day of capacity required for a particular use or building shall
be made by the Authority based upon sound engineering criteria and
estimates based upon the size and type of building and the intended
use. Any person or entity challenging the Authority's determination
of the capacity required for a particular property or use must establish
that the Authority's determination is invalid and lacks a valid foundation.

For any property which contains multiple uses, including both
residential and nonresidential uses, the capacity that must be secured
shall be determined based upon the total amount of the capacity required
for all buildings and uses on the property, and the tapping fee that
must be paid shall be based upon the tapping fees as set forth above
for each building and use at the property.

For any property regarding which the Township or Authority does
not allocate the full capacity requested, all required tapping fees
shall be based upon the capacity which is actually allocated by the
Township or Authority. Additional tapping fees shall be required later
if further allocations of capacity are made.

(2)
|
The tapping fee for all GPD of capacity shall be calculated
as follows:
| |||||
(a)
|
Calculation of tapping fee amount. The Township hereby approves
and adopts the report of consulting engineer CKS Engineers, Inc.,
Document Ref: No. 3100-61 dated March 7, 2014. A true and correct
copy of such report shall be available for inspection at the Township
offices.

The basic tapping fee shall be $25.68 for each GPD of capacity
for any property whose flows are not conveyed to or through the Abington
system and are not conveyed to or through the Upper Southampton system
in any manner. For such properties, in the event any use or building
on the property shall utilize, directly or indirectly, any facility
that is part of the "capacity part" or the "distribution or collection
part" as such terms are utilized in the Municipality Authorities Act,
53 Pa.C.S.A. § 5607(d)(24) and as set forth in the CKS Engineers,
Inc., report, the tapping fee shall be as follows:

$1.80 per GPD for the capacity part; and
| |||||
[b]
|
$23.88 per GPD for the distribution or collection part.
| |||||

For all properties whose flows are conveyed to or through the
Abington system or are conveyed to or through the Upper Southampton
system in any manner, the tapping fee shall be determined as follows:

|
The property shall be charged a tapping fee for the distribution
or collection part of $23.88 per GPD if any flow from such property
uses any part of the Lower Moreland system;
| |||||
[b]
|
The property also shall be charged a tapping fee for the capacity
part equal to the greater of: i) $1.80 per GPD; or ii) the amount
which the Authority or the Township is required to pay to Abington
or to Upper Southampton in regard to such property.

All properties located in any area for which the Authority or
Township has adopted, now or in the future, a "special purpose" tapping
fee shall also be required to pay such special purpose tapping fee
in addition to the capacity part and to the distribution or collection
part set forth above in this ordinance.

|
All properties which discharge flows which utilize any facilities
for which the Authority or Township have agreed with any person or
entity to charge and to transfer to such person or entity a "reimbursement
part" in accordance with 53 Pa.C.S.A. § 5607(d)(24), or
any other statute, shall also be required to pay such reimbursement
part in addition to the capacity part and to the distribution or collection
part and to the "special purpose" part.

(b)
|
For all properties located in the area shown on any special
purpose tapping fee plan adopted now or at any time in the future
by the Commissioners or Authority, other than any property in the
area designated as the "Grasshopper Lane-Inverness Area Project,"
there shall also be due and owing a "special purpose tapping fee"
as such term is used in the Municipality Authorities Act (Act of June
19, 2001, P.L. 287, 53 Pa.C.S.A. § 5601 et seq.) and as
set forth in the CKS Engineers, Inc., reports. Such special purpose
tapping fee shall be in addition to the basic tapping fee. For all
properties located in the area shown on any special purpose tapping
fee plan adopted now or at any time in the future by the Commissioners
or Authority, other than any property in the area designated as the
"Grasshopper Lane-Inverness Area Project," the special purpose tapping
fee shall be $40.69 per GPD for all connections during 2006, and such
special purpose tapping fee shall automatically increase on January
1 each year, beginning on January 1, 2007, at the rate of 9% from
what such special purpose tapping fee was during the prior year, with
such annual increases in the special purpose tapping fee stopping
once the special purpose tapping fee reaches $80.15 per GPD, being
the maximum special purpose tapping fee which can be charged in all
portions of the special purpose tapping fee area pursuant to the CKS
reports, other than properties in the Grasshopper Lane-Inverness Area
Project.

If a property is partially in a special purpose tapping fee
area and partially outside of such area, then the special purpose
tapping fee shall be due in regard to any structure or any use on
the property which is completely or partially within the special purpose
tapping fee area.

(c)
|
For all properties located in the area designated as the "Grasshopper
Lane-Inverness Area Project," as adopted by the Authority, there shall
also be due a "special purpose tapping fee" as such term is used in
the Municipality Authorities Act (Act of June 19, 2007, P.L. 287,
53 Pa.C.S.A. § 5601 et seq.) as follows:

The special purpose tapping fee for all residential areas located
in the Grasshopper Lane-Inverness Area Project shall be $7,500 for
each dwelling unit for all properties which connect during 2008, and
such special purpose tapping fee shall automatically increase on January
1 each year, beginning on January 1, 2009, at the rate of 9% from
what such special purpose tapping fee was during the prior year, with
such annual increases in the special purpose tapping fee stopping
once the special purpose tapping fee reaches $13,348, being the maximum
special purpose tapping fee which can be charged in the Grasshopper
Lane-Inverness Area Project pursuant to the CKS reports. If a property
is partially in the Grasshopper Lane-Inverness Area Project and partially
outside of such area, then the special purpose tapping fee shall be
due in regard to any structure or any use on the property which is
completely or partially within the special purpose tapping fee area.
Such special purpose tapping fee for residential areas is based upon
each dwelling unit of such residential area being required to possess
an allocation of 202 gallons per day (GPD) of capacity.

The special purpose tapping fee for all nonresidential areas
in the Grasshopper Lane-Inverness Area Project shall be $37.15 per
GPD for all connections during 2008, and such special purpose tapping
fee shall automatically increase on January 1 each year, beginning
on January 1, 2009, at the rate of 9% from what such special purpose
tapping fee was during the prior year, with such annual increases
in the special purpose tapping fee stopping once the special purpose
tapping fee reaches $66.08 per GPD, being the maximum special purpose
tapping fee which can be charged in the Grasshopper Lane-Inverness
Area Project pursuant to the CKS reports.

If a property is partially in the Grasshopper Lane-Inverness
Area Project and partially outside of such area, then the special
purpose tapping fee shall be due in regard to any structure or any
use on the property which is completely or partially within the Grasshopper
Lane-Inverness Area Project.

Any reimbursement tapping fee component to which any developer or other entity or person is entitled under 53 Pa.C.S.A. § 5607(d)(24)(i)(C)(IV) or under § 10507-A(c) of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10507-A(c), or under any other statute, shall be due and shall be payable in accordance with all such applicable statutes and shall be in addition to any tapping fee otherwise due under this ordinance or under Chapter A214, Fees, of the Lower Moreland Township Code. In the event that none of the facilities that are the basis for the calculation of the capacity part or that none of the facilities that are the basis for the calculation of the distribution or collection part of the tapping fee as set forth under 53 Pa.C.S.A. § 5607(d)(24) or § 10507-A of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10507-A, or under the CKS Engineers, Inc., reports referenced in this ordinance, will be utilized in any manner or degree relative to the treatment or conveyance of sewage from a specific property, then the applicable capacity part or distribution or collection part of the tapping fee under this ordinance or under Chapter A214, Fees, of the Lower Moreland Township Code shall not be due or owing.

Resolution No. 14-02 of the Lower Moreland Township Authority,
adopted on April 2, 2014, titled "Resolution Establishing Sewer Tapping
Fees Imposed With Respect to New Connections and Changes in Existing
Connections to the Public Sewers, Including Setting the Amount Charged
as the 'Capacity Part,' the 'Distribution or Connection Part,' and
the 'Special Purpose Part' of the Tapping Fee, and Imposing a 'Reimbursement
Tapping Fee' on Any Property in Any Area Where Such a Fee Is Required
or Permitted To Be Charged, Establishing the Terms of Any Allocation
of Sewer Capacity, and Amending Existing Resolutions," is hereby incorporated
by reference. Such Authority resolution shall apply to all issues
as to the timing of when payment of the capacity part, the distribution
or collection part, and the special purpose part of the tapping fee
is due, including the payment of the tapping fee in installments;
the effect of an allocation having been made; and releases in the
event an allocation is made and cannot be used. The timing of when
payment shall be due of any reimbursement part of any tapping fee
shall be in accordance with any agreement made by the Township or
the Authority as to such reimbursement, or in accordance with any
statute governing such right of reimbursement, or such reimbursement
part shall otherwise be due and owing in full at the earlier of the
time of connection of the property or when sewer capacity shall have
been both requested and allocated for such property.
