Village of Ardsley, NY Chapter A210 Fees

[HISTORY: Adopted by the Board of Trustees of the Village of Ardsley 9-15-1986 by L.L. No. 8-1986. Amendments noted where applicable.]

§ A210-1 Legislative intent.

The Village of Ardsley, New York, recognizes that permit and other fees are scattered throughout the Code so that it is often difficult to locate the fee required in a particular case. Therefore, a set fee for each activity is hereby enumerated.

§ A210-2 Conflicts with other chapters.

The fees set forth in the Code, if different from the fees set forth herein, are hereby canceled, and the fees set forth in this local law are substituted therefor. All of the fees set out herein are for the frequency set forth in § A210-3.

§ A210-3 Fees enumerated.

The following are the applicable fees, the chapter in the Code in which the activity is set out and the amount and frequency of the fee:

A. Chapter 42, Alarm Devices and Systems.

(1) Residential annual alarm permit fee: $40.

(2) Nonresidential annual alarm permit fee: $75.

A.1. Chapter 44, Amusement Devices.

(1) For an operator: $100 annually.

(2) For an owner/distributor: $100 annually.

(3) Decal:[1] $25 per decal.

A.2. Chapter 50, Antennas.

(1) For an antenna permit: $50.

(2) For a building permit for an antenna: the fee set forth in § A210-3B for a building permit.

B. Chapter 64, Building Construction.

(1) Building permit:

(a) For new residential dwellings: $75 per filing, plus $2.50 per square foot of floor area.

(b) For new commercial buildings: $75 per filing, plus $3.50 per square foot of floor area for the first 20,000 square feet, plus $3 per square foot for the floor area in excess of 20,000 square feet.

(c) For all other work, including additions, renovations or alterations: $75 per filing, plus $20 per $1,000, or any part thereof, total value.

(d) For legalization of existing structures: $150 per filing, plus $40 per $1,000, or any part thereof, total value. In any event, the minimum legalization permit fee shall be $500.

(e) For roofing and siding: $125 per filing. This includes all permit and CO fees.

(f) For sheds on residential properties: $125 per filing. This includes all permit and CO fees. For sheds on commercial properties, the fees listed in Subsection B(1)(b) and (c) above apply.

(g) For backup generators on residential properties: $125 per filing. This includes the permit and CO fees. For generators on commercial properties, the fees listed in Subsection B(1)(c) above apply.

(h) For the renewal of a building permit: 50% of the original permit fee. In any event, the minimum permit renewal fee shall be $50.

(2) House sewer connection:

(a) New, replacement or repair: $125.

(b) Sewer tie-in: $250.

(3) New installation or replacement of any gas or oil burner or of any gas, electric, oil or solar hot-water heater: $75.

(4) Certificate of occupancy:

(a) For a total value of up to $5,000: $15 per application.

(b) For a total value of $5,001 to $50,000: $25 per application.

(c) For a total value of $50,001 and over: $45 per application.

(d) For new residential buildings: $100 per application.

(e) For new commercial buildings: $200 per application.

(f) For reissuance: $25 per application.

(g) For certification: $20.

(h) For applications involving the legalization of existing structures, all fees shall be doubled.

(i) For conditional or temporary certificates for residential buildings: $100 per application.

(6) Storm sewer installation (commercial and residential):

(a) Street connection to building wall: $200.

(b) One to three connection to leaders, gutters, drains, floor area or canopy drains: $50.

(c) All connections over three: $10.

(7) Water service: new, replacement or repair:

(a) Three-fourths inch: $100.

(b) Three inches and up: $250.

(8) Fire water service sprinkler, standpipe or combination (this covers inspection):

(a) For a single-family dwelling: $75 plus $3 per head.

(b) For multifamily and commercial buildings: $150 plus $4 per sprinkler head.

(9) Plumbing fixtures:

(a) Installation one to three plumbing fixtures appliances or standpipe connections: $75.

(b) Any over three: $10 per fixture.

(10) Lawn sprinklers, irrigation systems and ornamental display fountains:

(a) One to 10 connections: $75.

(b) All connections over 10: $5 each.

(11) Any gas-supplied fixture or unit: $50.

(12) Replacement of any plumbing fixtures: $15.

(13) Reinspection penalty fee: $100.

(14) Electric fees. The fee for a permit shall be $15 per $1,000 or any part thereof of the total job cost. In any event, the minimum permittee shall be $75. For applications involving the legalization of electrical work, all fees shall be doubled.

(15) Plumbing fees. Notwithstanding any other provision with respect to fees under § A210-3, the minimum plumbing permit fee shall be $75. For applications involving the legalization of plumbing work, all fees shall be doubled.

(16) HVAC fees.

(a) For residential work: $50 per compressor and $50 for all new ducts.

(b) For commercial work: $150 plus $10 per ton.

(17) Fire inspection fees:

(a) Multifamily and dormitory: $100, plus $10 per unit.

(b) Commercial (up to 5,000 square feet): $100.

(c) Commercial (over 5,000 square feet): $100, plus $10 per additional 1,000 square feet.

(d) Private schools: $100, plus $10 per 1,000 square feet.

(e) This fee schedule shall apply to the initial inspection, plus one follow-up inspection for the purpose of verifying that deficiencies have been corrected. Additional inspections necessitated by further uncorrected deficiencies shall require an additional fee equal to 1/2 of the initial fee for each additional inspection.

(18) Title search fees.

(a) $50 for one- and two-family dwellings plus $0.25 per page for each paper document provided.

(b) $75 for multifamily plus $0.25 per page for each paper document provided.

(c) $100 for commercial and mixed-use buildings plus $0.25 per page for each paper document provided.

(d) $150 for the shopping centers in the B-3 District plus $0.25 per page for each paper document provided.

D. Chapter 105, Excavations.

(1) Excavations: $50 per application.

DD. Chapter 109, Filming.

(1) Commercial filming in commercial district: $5,000 per day (minimum).

(2) Commercial filming in parks/residential areas: $2,000 per day.

(3) Nonprofit/student¹ filming in commercial district: $1,500 per day.

(4) Nonprofit/student¹ filming in parks/residential areas: $500 per day.

¹NOTE: Student is defined as "one enrolled in post-high-school education."

E. Chapter 112, Fire Prevention.

(1) Inspections: $100 each.

(2) Cellulose nitrate film: $100 annually.

(3) Fireworks: $500 per event.

(4) Flammable liquids:

(a) For the storage, handling, or use of Class I, II or III: $100 annually.

(b) For the manufacture, process, blend or refine: $5,000 annually.

(c) For storage in stationary tanks: $150 annually.

(d) For automobile garages: $100 annually.

(e) For hazardous chemicals: $250 annually.

(f) For liquefied petroleum gas: $25 annually.

(5) Bonfires: $500 per event.

(6) Storage of combustible materials: $250 annually or $25 daily.

F. Chapter 122, Garbage, Rubbish and Refuse.

(1) Commercial waste disposal, weekly volume:

(a) For one to five thirty-gallon containers per week: $55 per month.

(b) For six to 10 thirty-gallon containers per week on average: $125 per month.

(c) For 11 to 20 thirty-gallon containers per week on average: $175 per month.

(d) For 21 or more thirty-gallon containers per week on average: $250 per month.

(e) For dumpsters: $275.

(2) Penalties for late payment: $25 for payment received more than 15 days after it is due and an additional $25 for every additional 15 days late until payment is received.

G. Chapter 132, Landfills.

(1) Landfill permit: $50 per application.

G1.	Chapter 143, Parking, Public Off-Street.
	(1)	For Village residents, Village businesses and employees of Village businesses: $120 per annum.
	(2)	For all others: $150 per annum.
	(3)	Section 143-4, Parking meter zones. [Added 1-7-2019 by L.L. No. 2-2019]
		(a)	Twenty-five cents per 15 minutes.
			$1 minimum for credit cards.

H. Chapter 148, Parks and Recreation.

(1) Tennis courts.

(a) For Ardsley residents:

[1] Family: $200 per season. [Note: "Family" shall include two adults living at the same home address and all children under age 22 living at the same home address, who shall not have reached their 22nd birthday by April 1 of the permit year.]

[2] Adult: $100 per season.

[3] Senior citizen: $60.

[4] Youth (18 and under): $60.

(b) For nonresidents:

[1] Family: $350 per season. [Note: "Family" shall include two adults living at the same home address and all children living at the same home address, who shall not have reached their 22nd birthday by April 1 of the permit year.]

[2] Adult: $200 per season.

[3] Senior citizen: $110.

[4] Youth (18 and under): $110.

(c) Guests shall be limited to not more than 50% of the players on the court and shall follow the individual, senior citizen and youth fees above.

(d) Single use, nonmember: $50 per hour.

(e) For entry device (key or fob), if lost: $25.

(f) Fee to participate in tennis clinics:

[1] For residents: $180.

[2] For nonresidents: $230.

(2) Park facilities: [Note: This pertains to baseball fields, softball fields, soccer fields, pavilions, gazebos, basketball courts and other amenities at McDowell Park and Louis M. Pascone Memorial Park.]

(a) Nonleague reservation of any park facility:

[1] Residents: $25 per hour.

[2] Nonresidents: $50 per hour.

(3) Community Center rental fee:

(a) For residents: $75 per hour.

(b) For nonresidents: $125 per hour.

I. Chapter 152, Peddling and Soliciting.

(1) For peddling and vending: $250 annually.

J. Chapter 165, Sewers.

(1) Sewer connections, nonresident direct connection: $1,000 upon connection.

(2) Sewer maintenance, nonresident direct connection: $50 annually.

K. Chapter 173, Streets and Sidewalks.

(1) Street openings:

(a) Concrete, macadam, brick or other hard surfaced road, sidewalk or public area $1.00 per square foot of opening or $500, whichever is greater.

(b) Gravel, dirt or other soft surfaced road, sidewalk or public area $0.50 per square foot of opening or $500, whichever is greater.

(2) Curb cuts: $10 per linear foot.

K.1. Chapter 184, Trailers, Storage.

(1) Permit application fee: $100 (nonrefundable).

(2) Following approval of application: $100 per month for every month trailer is located on property.

L. Chapter 190, Vehicles and Traffic.

(1) Overweight vehicles:

(a) Application for permit; permit valid for 30 days: $25.

(b) Renewal of permit; each renewal valid for 30 days; renewable twice: $10 each renewal.

(2) Overnight parking: $25 annually; replacement: $5.

(3) Permit parking.

(a) For Village residents, Village businesses and employees of Village businesses: $280 per annum.

(b) For all others: $500 per annum.

(c) Permit parking sticker replacement fee prior to expiration: $10.

(d) Prorating of fees will be permitted on a schedule as determined by the Village Manager.

(4) Parking meters, one- and two-hour:

(a) Twenty-five cents per 15 minutes.

(b) $1 minimum for credit cards.

M. Chapter 200, Zoning.

(1) Zoning Board of Appeals filing fee: $200 per applicant.

(2) Zoning Ordinance reproduction: $25.

(3) Zoning Map reproduction: $5.

(4) Recreation fee for assisted, independent and/or special needs living units in the CCH District: $600 per unit.

(5) For a permit to disturb any wetland, watercourse, waterbody, floodplain or wetland buffer area: $250.

(6) For a permit to disturb a steep slope area: $250.

(7) Public donation bin permit fee: $100.

N. Miscellaneous.

(1) Auto wrecking, junkyard waste material handling plant: $500 annually.

(3) Dry-cleaning plants, wet-cleaning plants and laundromats: $100 annually.

(b) Over 5,000 square feet: $100, plus $10 per additional 1,000 square feet.

(6) Photocopies of documents provided under the Freedom of Information Law: the maximum amount permitted by the Freedom of Information Law.

(7) Police accident report: $5.

(8) Planning Board site plan review:

(a) Original application: $250.

(b) Amended application: $200.

(9) Residential subdivision: $2,000 per unit or lot.

(10) Residential site plan: $2,000 per unit or lot.

(11) Residential site plan. CCH or R-4 District: $2,000 per unit or lot.

(12) Subdivision application fee: $1,000.

(13) Notary fees: Two dollars per notarization.

(14) [6]Food trucks conducting business under the auspices of the Village of Ardsley: $100 per event.

(19) Leaf blower permits:

(a) Issued to the owners of properties containing one- and two-family dwellings: $5.

(b) Issued to the owners of commercial or multifamily properties: $25.

(c) Issued to any business entity working on residential or commercial properties: $25.

(20) Dumpster permit fee: $100 for a period not to exceed five days, plus $40 per day per parking meter blocked by the dumpster. The applicant shall deposit with the Village $250 in cash or certified check to reimburse the village for all expenses which may be incurred by it in restoring any damage created by the placement, use, removal and/or relocation of the dumpster.

§ A210-4 Amendments.

The Board of Trustees, by resolution, may add or delete fees or may increase or decrease any of the above fees.

§ A210-5 Permits nontransferable.

Any permit or license issued for said fees shall be to the individual named and may not be assigned or transferred to any other person or corporation to the end that any new activity or change of ownership will require a new permit.

§ A210-6 Penalties for offenses.

A. Failure to apply, pay for and obtain any permit or license hereunder shall invoke the penalty provided in the Code for failure to obtain such a license.

B. Invalidation of any of the provisions of this chapter shall not invalidate any of the other provisions hereof.
