Editor's Note: Pursuant to L.L. No. 1-1976 which established
the Code, the provisions of this chapter were originally designated as Ch.
8.
This Code of Ethics shall apply to all officers and employees, whether
elected or appointed, of the Incorporated Village of Bellerose and shall be
applicable whether or not such officers or employees receive compensation
with reference to their services.
In addition to any conflicts of interest prohibited by the statutes
of the state of New York, no person to whom this Code of Ethics applies shall
be or become interested directly or indirectly in any manner whatsoever, except
by operation of law, in any business or professional dealings with the Incorporated
Village of Bellerose or any agency thereof. No such person shall act as attorney,
agent, broker, representative or employee in business or professional dealings
with the Incorporated Village of Bellerose or any agency thereof. No such
official shall accept any employment or engage in any business transaction
or make any investments, directly or indirectly, which create a conflict with
official duties.
No person to whom this code applies shall accept any valuable gift,
whether in the form of services, loan, thing or promise or any other form,
from any person, firm, partnership or corporation which to his knowledge is
interested directly or indirectly in any manner whatsoever in business or
professional dealings with the Incorporated Village of Bellerose or any agency
thereof.
Every person to whom this Code of Ethics applies who has either direct
or indirect financial or other private interest in any measure being considered
by the Board of Trustees or by any other official board, agency, officer or
employee of the Incorporated Village of Bellerose and who participates in
discussions before or gives opinions to such board, agency or individuals
shall publicly disclose the nature and the extent of such interest. Every
person to whom this Code of Ethics applies who shall have the knowledge of
any matter being considered by any board, agency, official or employee of
the Incorporated Village of Bellerose, in which he has any direct or indirect
financial or other private interest, shall publicly disclose his interest
to such board, agency, officer or employee and the nature and extent thereof
as soon as practically possible after becoming informed of such matter. A
copy of every such disclosure required therein, including a copy of every
transcript containing such a disclosure, shall be promptly transmitted by
the board, agency, officer or employee to the Village Clerk, who shall file
and maintain same as a public record.
No officer or employee of the Village, whether paid or unpaid, shall
disclose confidential information concerning the property, government or affairs
of the Village or any other confidential information of an official character
except when permitted or required by law, nor shall he use such information
to advance the financial or other private interests of himself or others.
No person to whom this Code of Ethics applies shall make use of official
Village stationery or the official Village Seal or any facsimilies thereof
for anything other than the business of the Incorporated Village of Bellerose.
No person to whom this Code applies shall make use of his title or designation
in an official capacity except for the business of the Incorporated Village
of Bellerose as authorized by law.
No person who has served as an employee or officer of the Village shall,
within a period of two years after the termination of such service or employment,
appear before any board or agency of the Village or receive compensation for
any services rendered on behalf of any person, firm, partnership, corporation
or association in relation to any matter with respect to which such person
was directly concerned or in which he personally participated during the period
under service or employment or which was under his consideration during the
period of his service or employment by the Village.
Violation of any of the provisions of this Code of Ethics shall constitute
cause for forfeiture of pay, suspension or removal from office or employment,
after a hearing governed by the principles of due process and a vote in that
regard by the Board of Trustees of the Incorporated Village of Bellerose.
