Editor's Note: Pursuant to L.L. No. 1-1976 which established the Code, the provisions of this chapter were originally designated as part of Ch. 30 and later redesignated as part of Ch. 77 by L.L. No. 2-1978.
There is hereby created and established a Department of Sanitation, which shall be under the supervision and control of the Commissioner of Sanitation, who shall be appointed by the Mayor with the approval of the Board of Trustees, for a period of one year, at such compensation as the Board of Trustees may from time to time determine. The Commissioner of Sanitation shall be responsible for the implementation of the provisions of Chapter 135, Littering, and may appoint such deputies, from time to time, as he may deem necessary to aid him in his responsibility. He shall be authorized to supervise the removal of garbage and litter from the confines of the Incorporated Village of Bellerose, pursuant to the provisions of any contract that may be entered into between the Incorporated Village of Bellerose and others. He shall be responsible for planning for the efficient removal of garbage and trash from the Incorporated Village of Bellerose. He is hereby empowered to make and to publish rules and regulations relating to the storage, collection and disposal of litter, provided that such rules and regulations are not contrary to the provisions of Chapter 135, Littering, and provided that the Village Board shall, prior to the coming into force and effect of such rules and regulations, approve same by resolution. Any violation of such rules and regulations made and published by the Commissioner of Sanitation shall constitute a violation pursuant to the provisions of Chapter 135, Littering.
The Commissioner of Sanitation or any other person authorized by the Board of Trustees shall have the power to enter and/or examine any vehicle, as defined herein, and the power to enter upon any private property at any reasonable hour, for the purpose of inspecting and investigating conditions relating to the enforcement of the provisions of Chapter 135, Littering.
