It shall be unlawful for any person or persons to conduct a garage sale within the Incorporated Village of Bellerose without first obtaining a permit therefor and without complying with the regulations set forth in § 115-3 of this chapter.
The permit required by this chapter shall be issued by the Clerk of the Incorporated Village of Bellerose upon application made in person and upon payment of such permit fee as shall be set by the Board of Trustees of the Incorporated Village of Bellerose. Each license so issued shall set forth the name of the person conducting such garage sale and the address at which such sale will be conducted, together with the date for which such sale is scheduled. The Clerk of the Incorporated Village of Bellerose shall keep a register of such permits applied for and issued and shall issue no more than one permit for a garage sale to be conducted within the Incorporated Village of Bellerose on any given date, it being the intention of the Board of Trustees to limit the number of garage sales scheduled to be held within the Incorporated Village of Bellerose on any given date to one such sale. The Village Clerk shall issue permits for garage sales in the order in which applications for such sales are received, so that the first application received by the Village Clerk for any particular date during the course of the year shall be entitled to a preference in the issuance of a permit for the holding of a garage sale on that date. The Village Clerk shall reject any application made to him for a garage sale permit which shall be received by him more than 15 days prior to the date on which such garage sale is scheduled to be held.
The following regulations shall apply to all garage sales held within the Incorporated Village of Bellerose:
A. 
The term "garage sale" is defined as any public sale of personal property in the residential area of the Incorporated Village of Bellerose but shall not include any such sale held by a charitable, religious or civic organization active within the Incorporated Village of Bellerose which shall have received a recognition of such status from the Board of Trustees of the Incorporated Village of Bellerose.
B. 
Garage sales shall not commence before 10:00 a.m. and must terminate by 5:00 p.m.
C. 
No more than two garage sales shall be held at any address in any one calendar year.
D. 
Every permit issued pursuant to the provisions of this chapter shall be valid for one day only, and a permit issued pursuant to the provisions of this chapter for a second garage sale at the same address on a consecutive date shall constitute a permit for a second garage sale.
E. 
Garage sales shall offer only used, unwanted items of personal property owned by the resident of the property where the sale is held. No new merchandise shall be offered for sale, nor may new merchandise from other sources be brought in and offered for sale.
F. 
Garage sales may be advertised through newspapers or other news media. A sign, not greater than two feet by two feet, may be installed on the property where the sale is being conducted, but only during the conduct of such sale. No sign shall be placed on any public street or on any property other than that where the sale is being conducted. No illuminated signs shall be used. The sign shall be displayed only during the sale and shall be removed promptly after the sale.
By the adoption of this chapter, it is not the intention of the Board of Trustees of the Incorporated Village of Bellerose to change or to amend the zoning provisions of the Code of the Incorporated Village of Bellerose.
Whoever shall violate or fail to comply with any of the provisions of this chapter shall be fined not more than $150, and each day that such violation continues shall constitute a separate offense.
