GENERAL REFERENCES
Public access to records — See Ch. A218.
The Village Clerk and other officials of the Incorporated Village of Bellerose, performing services for members of the public who make the request for such services, shall receive in advance the fees hereinafter set forth. Such fees shall be paid to the Village Clerk of the Incorporated Village of Bellerose, in cash or by certified check, bank check or money order.
The Village Clerk or other official of the Incorporated Village of Bellerose shall perform no service requested of him by a member of the public until he shall have first been paid the fee with reference thereto.
In the event that the fee is to be calculated according to the amount of time to be expended by the Village Clerk or other official of the Incorporated Village of Bellerose, the advance payment required shall be in a sum not less than four times the hourly rate set by this resolution. If the Village Clerk or other official of the Incorporated Village of Bellerose shall then expend a lesser amount of time than four hours in connection with such requested activity, appropriate refund shall be made. In the event that the Village Clerk or other official of the Incorporated Village of Bellerose shall expend a greater amount of time than that for which the fee has been paid, the relevant official of the Incorporated Village of Bellerose shall require the payment of any additional hourly fee before the delivery of any information to the person requesting same.

The Board of Trustees, by duly adopted resolution, shall establish and, from time to time, amend the fees to be charged in connection with the performance of the following:
A. 
For searching the records of the Incorporated Village of Bellerose: an hourly rate with a minimum search fee.
B. 
For preparing any certificate setting forth findings on the search of Village records.
C. 
For the issuance of any permit required by law, local law or ordinance, except as otherwise herein provided.
D. 
For the issuance of any certificate attesting to the completion of any work performed under any permit issued plus the inspection fee required under Subsection W of this section.
E. 
For the issuance of any license required by law, local law or ordinance.
F. 
Certificates of occupancy.
(1) 
For the issuance of a certificate of occupancy for a premises used entirely for residential purposes plus a rate per hour or any portion thereof for any services required to be performed by any official or employee of the Village in connection with an inspection and observation of the property, incidental to and necessary in connection with the issuance of such certificate of occupancy.
(2) 
For the issuance of a certificate of occupancy with reference to a building that is either, in whole or in part, nonresidential: a fee plus a rate thereof for any services performed or required to be performed by any official or employee of the Village in connection with an inspection and observation of the property, incidental to and necessary in connection with the issuance of such certificate of occupancy.
(3) 
Such fees shall be in addition to those required herein to be paid for a construction permit or for alteration permit.
G. 
Construction permit; alteration of existing structure erected without permit.
(1) 
For the issuance of a permit for the construction of any building or of any construction whatsoever, as that term is defined by the Bellerose Village Code § 68-66. There shall be a minimum fee to the extent that the total valuation of the construction shall not exceed $1,000. To the extent that such construction shall exceed $1,000, another fee shall be charged plus additional fees for each additional $1,000 or fraction thereof.
(2) 
For a permit to alter an existing structure already erected without a permit, the fee shall be three times the regular fee.
H. 
Structural alteration or enlargement; maintaining of existing structure erected without a permit.
(1) 
For alterations as defined by Bellerose Village Code § 210-1 of any structure or building, insofar as a permit therefor is required, the fee shall be the same as above set forth for a building permit.
(2) 
For a permit to maintain an existing structure already erected without a permit, the fee shall be three times the regular fee.
I. 
For any requested inspections made by an official or employee of the Village or for any inspections which shall appear to a constituted official of the Village to be necessary or required.
J. 
For plan review, where either a permit or no permit is requested.
K. 
For additional plan review, required by changes, additions or revisions to approved plans.
L. 
In the event that an application is made for a building or an alteration permit, but the application is not approved, the applicant shall be entitled to refund of a portion of the fee paid, provided that no work has been commenced, as set by the Board of Trustees.
M. 
For the issuance of a demolition permit for any building or any structure whatsoever and to the extent that such demolition permit is required:
(1) 
If the building or structure is located in the Residence District or if the building or structure is located in the Business District. In addition thereto, the applicant shall pay an hourly rate or any portion thereof for any services required to be performed by any official or employee of the Village in connection with an inspection and observation of the property, incidental to and necessary in connection with the issuance of such certificate of demolition or incidental to and necessary in connection with governmental supervision of the work being performed under the demolition certificate. If the building or structure being demolished is located in the Business District, the inspection and observation fee shall be an hourly rate. In connection with the issuance of any certificate of demolition, the official issuing that certificate may require a reasonable deposit of the person to whom it is issued, to guarantee the payment of such inspection fees as are above set forth and are considered likely by the issuing official to be incurred during the course of demolition.
(2) 
Certificate of demolition in connection with a construction permit or an alteration permit for structures located in the Residence District and for structures located within the Business District, except that the hourly fee incident to inspection and observation by a Village official during the course of the demolition itself shall continue to be applicable as set forth above and shall continue to be paid as set forth above.
N. 
For issuance of a temporary certificate of occupancy, plus the inspection fee set forth in Subsection I of this section; and for second and subsequent temporary certificates of occupancy, plus the inspection and observation fee set forth in Subsection W of this section.
O. 
For the renewal of a construction permit or an alteration permit or a demolition permit, after the same shall have expired.
P. 
For each street opening to ensure the proper closing of such opening.
Q. 
For each permit issued under any section of the Code of the Incorporated Village of Bellerose governing signs with an additional fee payable upon the issuance of the permit therefor.
R. 
For each and every application made to the Board of Trustees of the Incorporated Village of Bellerose, as such application may be required by the positive provisions of the Code or law. However, nothing herein shall be construed as to require the payment of any fee whatsoever for the exercise of the right of all residents to address the Board of Trustees for redress of grievances.
S. 
For preparing and certifying a copy of a paper filed or recorded in the office of the Clerk of the Incorporated Village of Bellerose: a fee for each page or portion thereof with a minimum fee.
T. 
For certifying a prepared copy of a paper filed or recorded in the office of the Clerk.
U. 
For preparing a copy of a paper filed or recorded in the office of the Clerk without certifying the same with a minimum fee.
V. 
For certification as to the removal of any violation of the provisions of the local laws or ordinances of the Incorporated Village of Bellerose dealing with building or zoning or related matters, which such certification fee shall include all inspections and observations by Village officials or employees necessary to be made or proper to be made in connection with the issuance of such certification, except that in the event that such inspection or observation shall exceed one hour, any additional time shall be paid for at the rate set in Subsection W of this section.
W. 
Separate fee and hourly rate for inspections and observations by Village officials or employees to be made in connection with any matter under this chapter, unless otherwise provided.
In addition to the above-scheduled fees, the Village Clerk and other officials of the Incorporated Village of Bellerose shall charge such fees for their services as shall be reasonable and proper in order that services performed by officials of the Incorporated Village of Bellerose for the benefit of individual persons or organizations shall not become a burden upon the taxpayers of the Incorporated Village of Bellerose.
Where the issuance of any certificate as set forth above shall require a preliminary search of the records of the Incorporated Village of Bellerose, the applicant for such certificate shall pay the fee set forth for the issuance of such certificate plus the search fee with reference thereto.

Anything above set forth to the contrary notwithstanding, the Village Clerk shall collect a fee to be established by the Board of Trustees, by resolution, upon the furnishing to any person of a copy of any of the ordinances or local laws of the Incorporated Village of Bellerose. However, the Village Clerk shall make no charge for permitting any person or organization to make her/his or their own copy, by their own devices or means of such local laws of ordinances upon and person making a deposit as the Board of Trustees may require by resolution.

The Board of Trustees is authorized to establish and from time to time amend, by resolution, a schedule of fees for applications, permits, approvals, licenses and any other matter where fees are authorized by law or under this Code.
