The emission of thick or dense smoke, soot, dust or cinders from a stack,
flue, chimney or fire of any description, shall be deemed, and is hereby declared
to be, a public nuisance and it shall be the duty of every person to refrain
from the commission of such act and no owner or person in charge of or having
control of any property, building locomotive or steamboat shall permit or
allow any such thick or dense smoke, soot or offensive or noxious odor, dust
or cinders to issue from any such stack, flue, chimney or fire; provided,
however, that the provisions of this section shall not apply to the escape
of smoke from any stationary stack, flue, chimney or fire for less than five
minutes in any eight-hour period.
