The Village of Pittsford hereby reserves to
itself the right to apply for and receive the authority to operate
under a permit issued by the New York State Thruway Authority, and
as amended from time to time, the Schoen Place Waterfront Park (Erie
Canal Park), including all Canal Corporation lands located on the
north side of the Erie Canal between the State Street Bridge and the
North Main Street Bridge.
Upon the issuance of such a permit to the Village
of Pittsford, the Village will assume the responsibility for the use
of occupancy of the said Schoen Place Waterfront Park. In that connection
the Village of Pittsford will establish rules and regulations to govern
the use and occupancy of the park, which rules and regulations shall
be binding upon all users of the Schoen Place Waterfront Park. The
purpose of such rules and regulations will be to assure the orderly,
safe, fair and equitable use of said Schoen Place Waterfront Park
by the residents of the Village of Pittsford, the operators of businesses
in said Village of Pittsford and others from outside the village limits.
Such rules and regulations will determine the particular length of
dock frontage to be used for private pleasure boats.
A.
Schoen Place Waterfront Park (Erie Canal Park) rules.

(1)
Between the hours of 12:00 midnight and 6:00 a.m.,
unreasonably loud, disturbing or unnecessary noise is prohibited.
(2)
Boat docking is limited to seven consecutive nights.
(3)
A pump-out station is available for boaters 24 hours
per day. It is located 0.3 mile to the west on the north shore.
(4)
Boaters are requested to be considerate of other park
users at all times.
(5)
The Village of Pittsford is not responsible for the
security of personal property.[1]

The canal path between the North Main Street Bridge
and the State Street Bridge is for pedestrians only and is a dismount
zone. Bicyclists, skaters, and skateboarders must dismount or use
the public street.

Smoking
is prohibited on park property, including parking areas and sidewalks
adjacent to such property.

(a)
Smoking is defined as the burning of a lighted cigar, cigarette,
or pipe, or any other matter or substance which contains tobacco.

in the park is prohibited.

The Village of Pittsford recognizes that the
New York State Thruway Authority has established rules and regulations
governing navigation and the use of the New York State Erie Canal
System. The Village of Pittsford restricts these rules and regulations
solely to the Schoen Place Waterfront Park use and occupancy.
The Village by its regulations and rules shall
encourage use of the Schoen Place Waterfront Park as a pedestrian
plaza and festival court for events to be sponsored not only by the
village but by the V61-2illage's licensees and/or permittees as well.
A.
Criminal penalty. Any person who violates any provision
of this chapter shall, upon conviction thereof, be subject to a fine
not to exceed $250 or to imprisonment for a term not to exceed 15
days, or both.
B.
Civil penalties; construal.
(1)
Obedience to the provisions set forth herein may be enforced by criminal information for the penalties herein prescribed, as well as by prosecution of the offender as provided in Subsection A of this section, or by civil action for a penalty or by civil remedy at law or equity by way of injunction or otherwise to abate or prevent a violation of the provisions of this chapter.
(2)
Neither a judgment in nor the pendency of a criminal
prosecution for an alleged violation of the provisions of this chapter
nor a judgment in or the pendency of a civil action of law or in equity
shall be a bar to the other form of proceeding.
(3)
The imposition of a penalty for a violation of this
chapter shall not excuse the violation or permit it to continue, and
the remedies herein provided for penalties and civil action to enjoin
or abate a violation shall be cumulative.
