A.
The Trustees of the Freeholders and Commonalty of
the Town of Southampton (hereinafter referred to as the "Town Trustees")
are empowered to regulate the taking of products (including fish and
other products) from the waters (including land below the waters)
within the Town of Southampton which are under the jurisdiction of
the Town Trustees (hereinafter referred to as "Town Trustee waters"),
including Town Trustee waters situate within the Village of Southampton.
The Rules and Regulations for the Management and Products of the Waters
of the Town of Southampton adopted by the Town Trustees (hereinafter
referred to as the "Town Trustee Rules and Regulations") regulate,
among other things, the taking of products from Town Trustee waters.
The purpose of this chapter is to provide specific authority in the
Village Code for enforcement by the village of certain Town Trustee
Rules and Regulations applicable to Town Trustee waters situate within
the village.
B.
Although the Town Bay Constables are authorized to
enforce the Town Trustee Rules and Regulations relating to the taking
of products from Town Trustee waters situate within the village, the
duties of the Town Bay Constables include enforcement with respect
to Town Trustee waters within the entire Town of Southampton, a large
geographical area containing numerous bodies of water which constitute
Town Trustee waters. The Village Board of Trustees finds that enactment
of this chapter will promote the objectives of certain Town Trustee
Rules and Regulations by providing additional enforcement authority
and assistance with respect to Town Trustee waters situate within
the village. The Village Board of Trustees finds that such additional
enforcement authority and assistance will benefit the inhabitants
of the town, including the inhabitants of the village.

C.
In the event that any provision of the Town Trustee Rules and Regulations incorporated by reference in § 60-2A above is amended by the Town Trustees, such provision shall automatically be deleted from § 60-2A above. The Village Board of Trustees may by resolution incorporate by reference in § 60-2A above the amended provision of the Town Trustee Rules and Regulations.
D.
In the event that the Town Trustees adopt new or additional provisions relating to the taking of products from Town Trustee waters, the Village Board of Trustees may by resolution incorporate by reference in § 60-2A above such new or additional provisions of the Town Trustee Rules and Regulations.
B.
Every person shall comply with the provisions of the Town Trustee Rules and Regulations incorporated by reference in § 60-2A above. A violation of any such provision shall constitute a violation of this chapter.
C.
Any person committing a violation of this chapter
shall, upon conviction thereof, be guilty of a violation pursuant
to the Penal Law of the State of New York, punishable by a fine not
exceeding $1,000 or by imprisonment for a term not exceeding 15 days,
or by both such fine and imprisonment. The continuation of a violation
of this chapter shall constitute, for each day the violation is continued,
a separate and distinct violation hereunder.
