A. No encroachment upon, into or over any public street
in the Village of Southampton shall be made or maintained.
B. As used herein, the term "encroachment" includes the
following:

(1) Any private use of any portion of a public street
for the display and/or sale of any products, goods, wares or merchandise.
(2) Any erection or fixing of a post or posts or similar
obstruction without first having obtained a written permit from the
Superintendent of Public Works to do so.
(3) Any underground excavation, including irrigation,
electrical or control wiring without first having obtained a written
permit from the Superintendent of Public Works to do so.
(4) Any planting of trees or other vegetation without
first having obtained a written permit from the Superintendent of
Public Works to do so.
(5) Any installation of concrete curb, Belgian block or
driveway apron without first having obtained a written permit from
the Superintendent of Public Works to do so.
C. As used herein, the term "public street" includes
the entire public right-of-way of a public street, including sidewalks.

A. This article shall not apply to a marquee in front
of any theater approved by the Board of Village Trustees.
B. This article shall not apply to a temporary encroachment
expressly authorized by resolution of the Board of Trustees, provided
that the temporary encroachment complies with such resolution of the
Board of Trustees.
C. This article shall not apply to use of the Village
sidewalk for outdoor sidewalk dining at a sidewalk dining area operated
by a licensed business pursuant to a license issued by the Village
Clerk for use of the Village sidewalk for outdoor sidewalk dining,
provided that such use is conducted in compliance with such license
and in compliance with rules and regulations established by resolution
of the Board of Trustees for use of the Village sidewalk for outdoor
sidewalk dining.

Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in Article
II of Chapter
1 of the Code of the Village of Southampton.
