The Police Committee of the Board of Trustees
(hereinafter referred to as the "Police Committee") shall provide
for the installation and maintenance of traffic control devices when
and as required under the provisions of this chapter, to make effective
the provisions of this chapter, and may install and maintain such
additional traffic control devices as it may deem necessary to regulate,
warn or guide traffic under the Vehicle and Traffic Law of the State
of New York, subject to the provisions of §§ 1682 and
1684 of that law.

A. General penalty. Except as provided in Subsections
B,
C and
D below, every person convicted of an offense against any provision of this chapter which is not an offense against any provision of the Vehicle and Traffic Law of the State of New York shall be deemed guilty of a traffic infraction and shall, for a first conviction thereof, be punished by a fine of not more than $75 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $125 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $300 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.
B. Penalties for parking on certain streets.
(1) Any person or persons violating the stopping, standing or parking restrictions as provided in Schedule L (§
110-43) of this chapter, except those streets or parts of streets marked with an asterisk (*), shall be liable to a fine of $75.
(2) Any person or persons violating the stopping, standing or parking restrictions as provided in Schedule L (§
110-43) and marked with an asterisk (*) shall be liable to a fine of $150.
(3) Any person or persons violating overtime parking shall
be liable to a fine of $75.
(4) The Board of Trustees may amend the amount of the
foregoing fines, from time to time, by resolution.
(5) Upon the failure of a person or owner of a vehicle
to appear or answer, on or before the return date or any subsequent
adjourned date, a summons or summonses charging that said person or
owner permitted a vehicle to be parked, stopped or standing in violation
of provisions of this chapter, late penalties shall be imposed as
follows: if the aforementioned fine shall not be paid within 30 days
from the date the summons was issued, a late penalty equal to the
original fine shall be added to the fine; if the fine is still not
paid within 60 days from the date the summons was issued, a second
late penalty equal to the original fine shall be added to the fine;
if the fine is still not paid within 90 days from the date the summons
was issued, a third late penalty of an additional $25 shall be added
to the fine; if the fine is still not paid within 120 days from the
date the summons was issued, a fourth late penalty of an additional
$50 shall be added to the fine.
C. Penalties for loading and unloading on certain streets. Any person or persons who shall cause a vehicle to be parked or remain standing in violation of §
110-31 of this chapter shall be liable to a fine of $75.
D. Other penalties.
(1) Every person convicted of a violation of §
110-16 or
110-40 shall be punished by a fine of $300.
(2) Every person convicted of a violation of §
110-16.1 shall be punished by a fine of $300.
(3) Every person convicted of a violation of §
110-45 shall be punished by a fine of $100.
If any Article, section, subsection, paragraph,
sentence, clause or provision of this chapter shall be adjudged by
any court of competent jurisdiction to be invalid, such adjudication
shall not affect, impair or invalidate the remainder thereof but shall
be confined in its operation to the Article, section, subsection,
paragraph, sentence, clause or provision thereof directly involved
in the controversy in which such judgment shall have been rendered.
All prior local laws, ordinances, regulations
and rules, or parts of such, of the Village of Southampton regulating
traffic and parking are hereby repealed, except that this repeal shall
not affect or prevent the prosecution or punishment of any person
for any act done or committed in violation of any local law, ordinance,
regulation or rule hereby repealed prior to the taking effect of this
chapter.
