The review process for a minor subdivision or land development
plan shall include a final application and final approval, as specified
in this section.
A. Final plan (application for final plan approval). The final plans
submitted to the Zoning Officer shall include all applicable requirements
specified in § 184-502 (Final subdivision plan requirements)
or § 184-504 (Final land development plan requirements),
as well as any further information deemed pertinent by the Zoning
Officer or Borough Engineer.

B. Borough Council public meeting.
(1)
Within 30 days following the filing of the application, the
Borough Council shall hold a public meeting on said application.
(2)
The Borough Council, within 15 days following the conclusion
of the public meeting, shall, by official written communication to
the applicant, either:
(a)
Grant final approval of the final plan as submitted; or
(b)
Grant final approval of the final plan subject to the specified
conditions not included in the final plan as submitted; or
(3)
When an application is not approved in terms as filed, Borough
Council's decision shall specify the defects found in the application
and describe the requirements which have not been met and shall, in
each case, cite to the provisions of the statute or ordinance relied
upon. The applicant may, within 10 days after receiving a copy of
the official written communication of the Borough Council, notify
the Borough of his refusal to accept some or all of such conditions,
in which event final approval of the final plan is deemed to be denied.
Where the applicant does not object to the conditions within this
ten-day period, the applicant shall be deemed to have accepted the
conditions.
(4)
Failure of Borough Council to so act within the required time
periods set forth above and as required by Pennsylvania Municipalities
Planning Code Section 508 shall be deemed to be a grant of final approval of the
final plan as submitted unless the applicant has agreed, in writing,
to an extension of time or change in the prescribed manner of presentation
of communication of the decision.
C. Record plan. A subdivision or land development plan, or any part
thereof, which has been given final approval shall be so certified
without delay by the Borough Council and shall be filed by the Borough
in the office of the Allegheny County Department of Real Estate within
90 days of the approval of the final plan before any development shall
take place in accordance therewith.
