There is hereby established the Department of Public Works.
The Department of Public Works shall have the authority of and provide the services currently provided by the Department of Highway/Property, the Department of Utility Maintenance/Operation, and the Electric Department. To that end, the Department of Public Works shall have the charge and supervision of:
A. 
The construction, operation, and maintenance of all Borough streets, alleys, public ways and stormwater facilities;
B. 
The construction, operation, and maintenance of all Borough buildings and properties;
C. 
The construction, operation, and maintenance of all water and sanitation sewer lines, sewage treatment facilities, and water supply, storage, and distribution facilities owned or operated by the Borough; and
D. 
The construction, operation, and maintenance of all Borough electric distribution systems and facilities.
The Borough Manager shall serve as the Director of the Department of Public Works and shall have full charge and supervision over all operations and employees of the Department of Public Works.

A. 
There are hereby established the offices of Superintendent and Assistant Superintendent, which shall be responsible for performing those duties assigned by the Director of the Department of Public Works.
B. 
The Borough Council may, at its discretion, appoint by resolution a Superintendent of the Electric Department and a Superintendent of the Department of Highway/Property who shall each report to the Director of the Department of Public Works. The Superintendents shall report to the Borough Manager whenever the position of the Director of the Department of Public Works is vacant.
C. 
The Borough Council may, at its discretion, appoint by resolution Assistant Superintendents who shall each report to the Superintendent of their respective departments.
Those physical assets of the water, sanitary sewer lines and the sanitary sewer plant formerly the property of the Middletown and Royalton Water Company shall be owned by the Middletown Borough Authority and shall be leased to the Borough for operation by the Department of Public Works. All physical properties of the Borough, including the rights-of-way, parks, playgrounds and all municipal utilities facilities, shall be and are hereby assigned to the Department of Public Works.
A. 
The Department of Public Works shall have such employees as may, from time to time, be authorized by Council and hired by the Borough Manager. The Borough Manager shall maintain and distribute job classifications/descriptions, educational and/or skill requirements, and pay levels. Nothing contained herein shall require the Borough to fill any vacancy existing in any job classification or to maintain a minimum number of employees within a classification.
B. 
All employees, regardless of job classification or description, shall be available to perform duties within the Department of Public Works as may be assigned to them from time to time by the Borough Manager or his designee.
