A.
There is hereby established the part-time position of
Constable in the Town of New Lebanon.
B.
The constable shall be appointed annually by the Town
Board and the annual salary for the office shall be determined by the Town
Board.

His duties shall be as outlined in this chapter.

Editor's Note: This local law was originally adopted as Ch. 37,
but was redesignated to maintain the style of the Code.
To be eligible to hold the position of Constable a person must have
been a resident of the Town of New Lebanon for a minimum of two years prior
to appointment. The person must have no felony convictions and must be a minimum
of 21 years of age at the time of appointment.
Applicants for the position of Constable shall submit to the Town Board
a completed application form provided by the town. All applicants will be
fingerprinted and will be subject to a criminal background check.
The Constable shall be authorized to issue appearance tickets of the
Code of the Town of New Lebanon and for nonmoving violations of the Vehicle
and Traffic Law. The Constable shall also be authorized to perform traffic
control functions and to maintain order in the town court. A Constable shall
not be a peace officer as defined in the Criminal Procedure Law. The Constable
shall attend any training courses required in the performance of his duties.
The Town Board may remove the Constable from office for cause after
notice and a hearing.
