A. 
Upper Pottsgrove Township presently, through its Codification of Ordinances, regulates vehicles and traffic pursuant to this Chapter 330.
B. 
Upper Pottsgrove Township wishes to establish a procedure whereby its Police Department can issue parking tickets for various parking and traffic violations.
C. 
In accordance with the provisions of the First Class Township Code,[1] the Township seeks to amend this Chapter 330 to specifically define various violations that can result in the issuance of tickets for traffic and parking violations.

Members of the Upper Pottsgrove Township Police Department and any special police assigned to traffic duty are hereby authorized to regulate traffic and parking on Township streets, roads, and alleys in accordance with the provisions of this article or, in emergencies, as public safety or convenience may require; and it shall be unlawful for any person to fail or refuse to comply with any lawful order, signal or direction of any police officer; except in case of emergency, it shall be unlawful for any person not authorized by law to direct or attempt to direct traffic.
In addition to general parking regulations contained in Article IV, General Parking Regulations, of this chapter, at any time it shall be unlawful to permit any vehicle to stand in any of the following places, except where necessary to avoid conflict with traffic or in compliance with the regulations of a police officer or traffic control device:
A. 
In any intersection.
B. 
In a crosswalk.
C. 
Upon any bridge or viaduct or in any subway or tunnel or approach thereto.
D. 
Between a safety zone and that adjacent curb or within 30 feet of a point of the curb immediately opposite the end of a safety zone.
E. 
Within 30 feet or 9.15 meters of a traffic signal, beacon, or sign on the approaching side.
F. 
Within 20 feet or 6.10 meters of any intersection or crosswalk.
G. 
At any place where the standing of a vehicle will reduce the usable width of the roadway for moving traffic to less than 18 feet.
H. 
Within 15 feet or 4.57 meters of a fire hydrant.
I. 
At any place where the vehicle would block the use of a driveway.
J. 
Within 50 feet or 15.15 meters of the nearest rail of a railroad grade crossing.
K. 
Within 20 feet or 6.10 meters of the driveway entrance to any fire department station, and on the side of the street opposite the entrance to any such station within 75 feet or 22.87 meters of such entrance when properly posted.
L. 
On any sidewalk or parkway and.
M. 
At any place where official signs prohibit parking.
No vehicle shall be parked with the left side of such vehicle next to the curb, except on one-way streets, and it shall be unlawful to stand or park any vehicle in a street other than parallel with the curb and with the two right wheels of the vehicle within 12 inches of the regularly established curbline, except that upon those streets that have been marked for angle parking, vehicles shall be parked at the angle to the curb indicated by such marks.
It shall be unlawful to park any motor vehicle on any private property without the consent of the owner of the property.
The Chief of Police or any other persons authorized by the Township Board of Commissioners shall cause signs to be posted in all required areas where parking is limited or prohibited, indicating such limitations or prohibitions.
A. 
It is unlawful for any person to park or leave standing any vehicle in a stall or space designed for physically handicapped persons if, immediately adjacent to and visible from such stall or space, there is posted a sign known as the "international wheelchair symbol," consisting of a profile view of a stylized wheelchair with occupant in white on a blue background, unless the driver of the car is disabled.
B. 
As used in this article, "disabled" means either having a physical condition requiring the use of a wheelchair, artificial limb, crutch, cane or walker, or having a physical disease making it difficult or impossible to walk more than 25 feet without shortness of breath or danger of impairment of health. A certificate by a person licensed to practice the healing arts in this commonwealth shall be acceptable by the Township as evidence under this article.
C. 
The provisions of Subsection A herein shall apply to all off-street parking facilities owned or operated by the Township or by any privately owned or operated parking lot.
The fact that an automobile which is illegally parked is registered in the name of a person shall be considered prima facie proof that such person was in control of the automobile at the time of such parking.
The traffic tag shall be substantially similar to the form attached hereto and made a part hereof as Exhibit A.[1]

A police officer shall have the authority to affix upon any vehicle parked in violation of any provision of this article, or any provision of Article IV, General Parking Regulations, of this chapter, as amended, a traffic tag giving notice of the violation and notifying the owner and/or operator of that illegally parked vehicle that if he or she shall pay the sum indicated on the violation notice at the office of the Upper Pottsgrove Township Police Department within seven days from the time of the notice, such amount shall be deemed as and shall constitute the full penalty for that violation.
Any person who violates any provision of this article and makes the payment described above within seven days thereof shall pay the maximum sum of $20. The amount described in this section may be amended by the Upper Pottsgrove Township Board of Commissioners from time to time by resolution.
Any person who fails to make payment within seven days as described in §§ 330-64 and 330-65 above may be cited under the Pennsylvania Motor Vehicle Code, Title 75 of the Pennsylvania Consolidated Statutes, and, upon conviction, be sentenced to pay fines and penalties as set forth in Title 75.
