Board of Health legislation — See Part III.
[Adopted 8-2-1926 by Ord. No. 1 (Ch. 3,
Art. XX, of the 1973 Code); amended in its entirety at time of adoption
of Code (see Ch. 1, General Provisions, Art. III)]
The Board of Health, as heretofore established
in the Borough in accordance with Title 26 of the Revised Statutes,
is hereby continued.
The Board of Health shall consist of seven members.
Each member shall be appointed by the Mayor with the consent of the
Council and shall serve for a term of four years, except in the case
of vacancies which shall be filled for the unexpired term only. In
addition, the Mayor may appoint, with the consent of the Council,
two alternates who shall be designated at the time of appointment
as Alternate No. 1 and Alternate No. 2. The alternate members shall
serve for terms of two years, except that the terms of the alternate
members first appointed shall be two years for Alternate No. 1 and
one year for Alternate No. 2. A vacancy occurring other than by expiration
of a term shall be filled by the Mayor with the consent of Council
for the unexpired term only. Alternate members may participate in
discussions but may not vote except in the absence or disqualification
of a regular member.
The Board of Health shall adopt rules and regulations
for its own government. It shall elect a President from among its
members.
The Board of Health shall appoint a Registrar
of Vital Statistics, Secretary and Sanitary Inspector, and may also
appoint such other officers or assistants as said Board of Health
may deem necessary. The appointment of the Registrar of Vital Statistics
shall be governed by N.J.S.A. 26:8-11 et seq. All appointees of said
Board of Health shall be governed by the rules of said Board and may
be removed for cause by said Board, unless governed otherwise by statute.
The police of the Borough, when on police duty, shall promptly report
to the Board of Health every violation of the health ordinances of
the Borough which may come within their observation or knowledge.
The Board of Health shall not contract liabilities
of any kind beyond the amount allowed by law, except on appropriation
made for its use by the Mayor and Council.
The Board of Health shall have all of the powers
provided in N.J.S.A. 26:3-31.

The Board of Health shall appoint a Clerk of
the Board of Health, who shall serve at the pleasure of said Board
of Health.
The Clerk of the Board of Health shall:
A.
Keep the minutes and records of the proceedings of
the Board of Health and publish, maintain and compile its ordinances
and resolutions.
B.
Keep the minutes and records of any Board of Health
committee, upon request of the chairman of the committee.
C.
Provide secretarial and clerical services for the
members of the Board of Health in the discharge of their official
duties.
D.
Perform such functions as are vested in the Clerk
of the Board of Health by the licensing provisions of state law or
ordinance.
E.
Issue and deliver all notices of meetings required
to be given to members of the Board of Health.
F.
Receive and transmit all communications to or on behalf
of the Board of Health.
G.
Charge and receive for the use of the Borough such
fees for transcripts or certifications as shall be authorized by the
Board of Health.
H.
Perform such other, different and additional powers,
functions and duties as may be prescribed by law or ordinance.
There is hereby adopted by the Board of Health
of the Borough of Shrewsbury for the purpose of establishing performance
standards and guidelines that certain New Jersey Administrative Code
known as "Public Health Practice Standards of Performance for Local
Boards of Health in New Jersey," the whole thereof. One copy of said
code hereinabove mentioned has been annexed to this article and is
hereby made a part of this article as if fully incorporated herein.
Three copies of said code have been placed on file in the office of
the Clerk of the Borough of Shrewsbury upon introduction hereof and
they will remain there on file for the use and examination of the
public until this section is adopted and, if this section is adopted,
will remain available to the public and on file in said Clerk's office
and in such other place as may be required by law.
