This article shall be known as the "Clearing of Snow From Sidewalks Within the Town of Fort Edward."
A. 
It is the general purpose and intent of this article to establish a policy for the clearing of snow from the sidewalks within the Town of Fort Edward, outside the Village of Fort Edward.
B. 
Said policy is needed to protect the public health, safety and general welfare of the citizens of the Town of Fort Edward.
This article is enacted pursuant to § 10 of the Municipal Home Rule Law of the State of New York and § 130 of the Town Law of the State of New York.
As used in this article, the following terms shall have the meanings indicated:
SIDEWALK
The area on each side of the road from the property line to the gutter line or, if there is a curb, to the roadway side of the curb that has a prepared cement, asphalt or other similar hard surface for the purpose of pedestrian traffic.
A. 
The Town of Fort Edward shall be responsible for the clearing and removal of snow from all the sidewalks within the Town of Fort Edward, outside the Village of Fort Edward, that run parallel to and border on State Route No. 4 (Broadway), Burgoyne Avenue and Schuyler Street.
B. 
The owner and occupant of premises and property abutting on any street within the Town of Fort Edward, outside the Village of Fort Edward, other than the previously stated State Route No. 4, Burgoyne Avenue and Schuyler Street, where a sidewalk is laid has the responsibility to keep the sidewalk in front of said premises or property free and clear from snow and ice, and upon default thereof, the Town of Fort Edward may provide for the removal thereof at the expense of the owner of the premises or property and that charge shall become a lien upon the premises or property benefited thereby, until paid.
