The Planning Board shall have the power and authority to employ experts and a staff and to pay for their services and such other expenses as may be necessary and proper, not exceeding, in all, the appropriations that may be made for such Board. The Planning Board may adopt rules and regulations in respect to procedure before it and in respect to any subject matter over which it has jurisdiction under this resolution or any statute, after public hearing by the Planning Board and subject to the approval of the Town Board.
The Planning Board shall have and exercise powers and duties with respect to the entire area of the Town of New Hartford outside the limits of the Villages of New Hartford and New York Mills as follows:
A. 
To prepare and change a Comprehensive Master Plan for the development of such entire area of the Town of New Hartford.
B. 
To make investigations, maps and reports and recommendations in connection therewith relating to the planning and development of the town and its future growth and affording adequate facilities for the housing, transportation, distribution, comfort, convenience, safety, health and general welfare of its population.
C. 
To approve or disapprove changes in the lines of existing streets, highways or public areas shown on subdivision plats or maps filed in the County Clerk's office.
D. 
To approve or disapprove the laying out of, closing off or abandonment of streets, highways or public areas, under and subject to the provisions of the Town Law and the Highway Law.
E. 
To approve all plats showing lots, blocks or sites, with or without streets or highways, and to pass and approve the development of plats already filed in the County Clerk's office, if such plats are entirely or partially undeveloped, and to control subdivisions.
F. 
Simultaneously with the approval of any such plat, to confirm and make changes in the zoning regulations applicable to the land included in any such plat, in accordance with the provisions of § 281 of the Town Law and amendments thereto.[1]

G. 
The Planning Board shall also exercise all other powers conferred upon it by the provisions of the Town Law and shall pass upon all matters which may be referred to it from time to time by resolution of the Town Board. It shall conduct hearings and perform its duties in accordance with such procedure as provided in §§ 272 to 281, inclusive, of the Town Law and acts amendatory thereof.
The Town Clerk of the Town of New Hartford shall file with the Clerk of the County of Oneida a certificate, in the form herewith attached,[1] certifying that the Planning Board of the Town of New Hartford has been authorized to approve plats showing lots, blocks or sites, with or without streets or highways, and to pass and approve the entire or partial development of plats already filed in the office of the Clerk of such county, in accordance with the provisions of § 276, as amended, of the Town Law.

A. 
The purpose of this article is to create a Town-Wide Planning Board for the benefit of the whole Town of New Hartford.
B. 
The Town Board of New Hartford does by this article create a Town-Wide Planning Board for the whole Town of New Hartford with a membership of seven members.
The adoption of this article is made pursuant to § 10 of the Municipal Home Rule Law and § 271 of the Town Law of the State of New York.
