The Town of New Hartford maintains a Police
Department for the protection of its citizens and employs and compensates
police officers and all appurtenant and necessary equipment for the
performance of the police duties for the protection of the life and
property of its citizens and to maintain peace and tranquility within
the community. Certain private establishments located within the Town
of New Hartford have requested that the police protection rendered
by the Town of New Hartford Police Department be extended upon the
private property of the business establishments for the peace, safety
and welfare of the patrons and protection of property. It has been
determined that the rendering of such services by the Town of New
Hartford Police Department is within the purview of police protection
rendered to the Town of New Hartford.
A.
Sangertown Square Mall, a well-established shopping
mall located within the boundaries of the Town of New Hartford, has
requested Town of New Hartford Police Department protection and services
during its business hours. The New Hartford Town Board has conducted
an investigation of the Sangertown Square Mall request and its particular
needs and has determined that the rendering of town police services
is within the legislative intent of this article.
B.
The New Hartford Town Board does hereby permit and
entitle police officers of the Town of New Hartford Police Department
to patrol upon private property open to the public and within the
Town of New Hartford, more specifically known as "Sangertown Square
Mall," during business hours as requested and approved by such private
property managers.
C.
St. Luke's - Memorial Hospital Center, a well-established
health-care facility campus located within the boundaries of the Town
of New Hartford, has requested Town of New Hartford Police Department
protection and services during its business hours. The New Hartford
Town Board has conducted an investigation of the St. Luke's - Memorial
Hospital Center campus request and its particular needs and has determined
that the rendering of town police services is within the legislative
intent of this article.

D.
The New Hartford Town Board does hereby permit and
entitle police officers of the Town of New Hartford Police Department
to patrol upon private property open to the public and within the
Town of New Hartford, more specifically known as "St. Luke's - Memorial
Hospital Center campus," during business hours as requested and approved
by such private property managers.

A.
The police officers who are conducting such patrols
upon the Sangertown Square Mall property shall do so under their authority
as Town of New Hartford police officers and under orders by the Town
of New Hartford Police Department and shall be so compensated for
their services rendered by the Town of New Hartford.
B.
The police officers who are conducting such patrols
upon the St. Luke's - Memorial Hospital Center campus property shall
do so under their authority as Town of New Hartford police officers
and under orders by the Town of New Hartford Police Department and
shall be so compensated for their services rendered by the Town of
New Hartford.

A.
The Town of New Hartford shall charge for services
rendered by the Town of New Hartford Police Department upon the Sangertown
Square Mall property the owner thereof at a rate to be fixed by the
Comptroller of the Town of New Hartford, which rate shall be $22 per
hour for police services for the first year from the effective date
of this article, such rate being all inclusive with no additional
costs. Thereafter, the rate is to be renegotiated and adopted by resolution.
B.
The Town of New Hartford shall charge for services
rendered by the Town of New Hartford Police Department upon the St.
Luke's - Memorial Hospital Center campus property the owner thereof
at a rate to be fixed by the Comptroller of the Town of New Hartford,
which rate shall be $22 per hour for police services for the first
year from the effective date of this article, such rate being all
inclusive with no additional costs. Thereafter, the rate is to be

All other rules, regulations and procedures
constituting the operating procedure of the Town of New Hartford Police
Department, as adopted by resolution of the Town Board on December
18, 1985, and amended from time to time, shall remain in effect and
are hereby affirmed except to the extent that this article shall modify
or amend.[1]

The Town of New Hartford Police Department is
an available police agency for the purposes of fingerprinting for
residents and out-of-town residents, when requested, for civil purposes.
Such fingerprinting is often a requirement for
many insurance companies and State of New York agencies, and the Town
of New Hartford Police Department is available to meet such requirements.
There is an expense attached to fingerprinting
procedures such as utilization of town personnel and materials, and
consequently, is an expense upon the taxpayers of the Town of New
Hartford.
