A. 
The primary function of the Chief of Police is to control, plan and direct the activities of the Police Department. In order to achieve the objectives of the position, it is imperative for the Chief of Police to delegate some of the Chief's powers, duties, and responsibilities to others, with the understanding that the responsibility for performance of the duties of the Chief of Police, and for the discharge of the duties of the Police Department and its members, shall always remain the ultimate responsibility of the Chief of Police, regardless of the Chief's delegation of any particular task or responsibility to another person.
B. 
The Chief of Police shall be the chief executive officer of the Police Department; shall have active charge of any police office or station maintained by the Department; and shall be the superior officer of all other police officers and school crossing guards of the Borough of Brentwood. His duties shall consist of the following:
(1) 
Administrative duties. The Chief of Police shall:
(a) 
Efficiently supervise the office and police force;
(b) 
Maintain good public relations with members of the public, citizenry and press;
(c) 
Coordinate the activities of the Brentwood Police Department with the activities of the other offices and officials of the Borough;
(d) 
Cooperate with other local, county, state and federal police agencies;
(e) 
Report to the Mayor of the Borough of Brentwood any complaints, written or oral, filed against any police officer for alleged misconduct or inappropriate behavior; be present at the investigation of such charges; keep a record of the charges, and evidence presented and defense offered;
(f) 
Keep all firearms, billies, belts, whistles, badges and all other properly belonging to the Brentwood Police Department under his control, and distribute the same as needed to all police officers, taking a receipt thereof from the officers to whom entrusted;
(g) 
Report to the Mayor of the Borough of Brentwood all citations and criminal complaints issued or sworn to by the Brentwood Police Department, and the dispositions of such citations and criminal complaints. In fulfilling this administrative duty, the Chief of Police shall maintain a full and comprehensive record of all citations and criminal complaints issued by the Police Department of the Borough of Brentwood; the dates of such issuance; the persons accused in such citations and criminal complaints; the charges levied against such person accused; the names of the police officers of the Borough who issue such citations and criminal complaints; the dispositions of such citations and criminal complaints; the dates of dispositions of such citations and criminal complaints; and the total police man-hours expended in issuing and disposing of such citations and criminal complaints;
(h) 
Attend all regular monthly meetings of the Council of the Borough of Brentwood and any other meetings specified by Council and give a monthly report of the Police Department;
(i) 
Perform all other administrative duties set forth in Chapter 2 of the Brentwood Borough Police Department Policy and Procedures Manual, adopted April 2000 and revised March 2005, so long as such duties do not conflict with the provisions of this article.
(2) 
Supervisory duties. The Chief of Police shall:
(a) 
Enforce the provisions of all ordinances, resolutions, motions, rules and regulations heretofore or hereafter lawfully adopted by the Council of the Borough of Brentwood relating to the operation and maintenance of the Brentwood Police Department;
(b) 
Notify all members of the Brentwood Police Department of the provisions of all ordinances, resolutions, motions, rules and regulations heretofore or hereafter lawfully adopted by the Council of the Borough of Brentwood relating to the operation and maintenance of the Brentwood Police Department;
(c) 
Detail such orders to the members of the Brentwood Police Department as may be necessary for then to execute the instructions of the Mayor as they relate to the manner in which their designated duties are to be performed;
(d) 
Inspect all members of the police force from time to time, supervise their general conduct, observe their performance of duty, and report the same to the Mayor and Council with such recommendations as he may deem advisable;
(e) 
Require subordinate officers to report on duty wearing the approved uniform;
(f) 
Prepare or cause to be prepared the work schedule of all police officers and patrolmen pursuant to the provisions of any existing collective bargaining agreement or Act 111 arbitration award, and pursuant to the instructions of the Mayor which are not in conflict with such existing collective bargaining agreement or Act 111 arbitration award, and pursuant to any determinations of the Council of the Borough of Brentwood relating to the total weekly hours of employment that shall apply to policemen;
(g) 
Investigate or cause to be investigated any and all crimes reportedly committed within the Borough;
(h) 
If available, report to the scene of any fatality, serious crime of violence or disaster affecting the Borough of Brentwood and to all serious fires, explosions, disasters, riots or other tumultuous assemblages within the Borough, assume command of the police officers there present, protect property, dispel all crowds if necessary and cause the arrest of any person refusing to take orders, disturbing the peace or inciting others so to do;
(i) 
Carry out all duties imposed upon him by law;
(j) 
To perform all other supervisory duties set forth in Chapter 2 of the Brentwood Borough Police Department Policy and Procedures Manual, adopted April 2000 and revised March 2005, so long as such duties do not conflict with the provisions of this article.
To the extent that the duties and responsibilities of the Chief of Police set forth in Chapter 2 of the Borough of Brentwood Police Department Policy and Procedure Manual, adopted April 2000 and revised March 2005, are in conflict with the provisions of this article, the provisions of this article shall prevail; otherwise, the provisions of this article and the provisions of Chapter 2 of the Borough of Brentwood Police Department Policy and Procedure Manual, adopted April 2000 and revised March 2005, shall be read together, so far as is possible and reasonable.
