Building construction — See Ch. 67.
The Township hereby adopts a certain document, three copies of which are on file in the office of the Secretary of Lower Providence Township, being marked and designated as the "International Mechanical Code, 2000 Edition," including Appendix A, as published by the International Code Council, Inc., as the Mechanical Code of Lower Providence Township in the Commonwealth of Pennsylvania (the "Mechanical Code"), for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to , use or maintenance of mechanical systems in Lower Providence Township, and providing for the issuance of permits and collection of fees therefor; and each of the regulations, provisions, conditions and terms thereof on file in the office of Lower Providence Township are hereby referred to, adopted and made a part hereof as fully set out in this chapter, with the additions, insertions, deletions and changes, if any prescribed in Section 3 of this chapter.
The following sections of the International Mechanical Code, 2000 Edition, are hereby amended and revised as follows:
Section 101.1, Title, is amended by the insertion of "Lower Providence Township."
Section 106.5.2, entitled "Fee schedule", is amended to read as follows:
Section 106.5.2. Fees and Inspections/Reinspections. The Board of Supervisors shall, by resolution, adopt a schedule of fees which shall be kept on file by the Township Secretary and shall be reviewed and revised as necessary by the Board of Supervisors.
Section 106.5.3 is deleted in its entirety.
The following section shall be added as Section 107.7
Section 107.7. Fee for Missed Inspections. The Board of Supervisors shall, by resolution, impose a fee to be paid by the permit holder when the permit holder or his or her agent has requested the Township Building Inspector to conduct any inspection described in this Section 107.7, and the Building Inspector is unable to conduct such inspection at the scheduled time due to any delay in completion of the work to be inspected cased by the permit holder or his or her agent.
Section 108.4 is amended to read as follows:
Section 108.4. Violation penalties. Any person who shall violate a provision of this code or shall fail to comply with any of the requirement thereof or who shall erect, install, alter or repair mechanical work in violation of the approved construction documents or directive of the Code Official or of a permit or certificate issued under the provisions of this code shall be guilty of a summary offense, punishable by a fine of not less than $100 nor more that $1,000 per day, plus costs and attorneys' fees, and upon default of the payment of the fine and costs, imprisonment not exceeding 30 days. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
Section 108.5 is amended to read as follows:
Section 108.5. Stop work orders. The fine for violation of a stop work order shall be not less than $100 nor more than $500, imposed and collected by the procedure specified in Section 108.4 of this code.
Nothing in this chapter or in the Mechanical Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, rights acquired, liability incurred or cause or causes of action acquired or existing under any ordinance; nor shall any just or legal right or remedy of character be lost, impaired or affected by this chapter.
