The Board of Supervisors of the Township of New Garden, being the municipal authority of said Township, hereby signifies its intention and desire to organize an authority under the provisions of the Municipality Authorities Act of 1945, as amended.[1]

The Chairman of the Board of Supervisors and the Township Secretary are hereby authorized and directed to execute on behalf of the Township of New Garden Articles of Incorporation for said Authority in the form required by said Act, which said Articles of Incorporation shall set forth, among other things, that the name of said Authority shall be New Garden Township Sewer Authority; that said Authority is formed under Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945"; that no other Authority organized under said Act or under the Act of June 28, 1935, P.L. 483, is in existence in and for the Township of New Garden, except Southeastern Chester County Authority heretofore organized by the Township pursuant to Articles of Incorporation approved November 18, 1952; that the name of the incorporating municipality is the Township of New Garden; and that there shall be five members of the Board of the Authority. The said Articles of Incorporation shall also set forth the names and addresses of the Supervisors and officers of the Township, they being the municipal authorities of the said Township, and the names, addresses and terms of office of the first members of the Board of the Authority appointed pursuant to § 6-3 hereof.

The following persons, citizens and residents of the Township of New Garden, are hereby appointed as members of the Board of said Authority for the terms of office indicated opposite their respective names, as follows.[1]

The proper officers of the Township are hereby directed as required by the Municipality Authorities Act of 1945, as amended, to publish notice of the day upon which said Articles of Incorporation will be filed with the Secretary of the Commonwealth of Pennsylvania; to file said Articles, together with a certified copy of this article and the necessary proof of publication with the Secretary of the Commonwealth; and to do all other things necessary or appropriate to effect the incorporation of New Garden Township Sewer Authority.

The governing body of the municipality has conducted a public hearing, notice of which was advertised once in the Chester County Law Reporter and once in The Daily Local News, a newspaper published and of general circulation in Chester County, Pennsylvania, as required by the Act hereinafter defined, for the purpose of organizing an authority under such Act and hereby signifies its intention and desire to organize an authority under the provisions of the "Municipality Authorities Act of 1945,"[1] as amended (the "Act"), to be known as "New Garden General Authority" (the "Authority").

The Chairman and the Secretary of the Municipality are hereby authorized and directed to execute on behalf of the municipality Articles of Incorporation for the Authority in substantially the form attached hereto as Exhibit A and made a part hereof.[1]

The Chairman and the Secretary of the Municipality are hereby authorized and directed to cause a notice of the substance of this article to be published once in the Chester County Law Reporter and once in The Daily Local News, a newspaper published and of general circulation in Chester County, Pennsylvania, as required by the Act.
The Chairman and the Secretary of the municipality are hereby authorized and directed to file said Articles of Incorporation, together with the necessary proofs of publication of the notices referred to in §§ 6-5 and 6-7 above, with the Secretary of the Commonwealth of Pennsylvania, and to do all other acts and things necessary or appropriate to effect the incorporation of the Authority.
The following named persons be and they hereby are appointed as the first members of the Board of the Authority, whose terms of office shall commence on the date of appointment and shall be computed from the first Monday in the month of January next succeeding the date of incorporation.[1]

The Authority shall undertake only such project or projects as shall hereafter be specified from time to time by resolution or ordinance of the governing body. The Authority shall have all powers granted by the Act which are necessary or desirable for purposes of carrying out such specified projects.
