There is hereby established an Economic Development and Planning Department which shall have and exercise all the powers and duties, as herein conferred by § 32-31 of this article and imposed by General Law, to administer and coordinate all matters relating to the planning and development of the City of Haverhill, whether they are residential, commercial or industrial or whether they are financed by federal, state or local funds.

The Mayor shall appoint an Administrator of
the Economic Development and Planning Department, who shall hold office
and serve at the pleasure of the Mayor.
A.
The Economic Development and Planning Department shall
consist of an Administrator who shall have administrative control
and technical supervision over the following City departments, boards
and council:

B.
The Administrator shall serve as a liaison representative
of the Mayor to the following municipal departments and other City
boards or authorities directly involved in the planning and development
of the City of Haverhill:

An Assistant to the Administrator of the Economic
Development and Planning Department shall be appointed by the Mayor,
who shall hold office and serve at the pleasure of the Mayor. The
Assistant Administrator shall be under the direct supervision of the
Administrator and perform his duties as outlined in the rules and
regulations of the Economic Development and Planning Department.

A.
The Administrator shall have the authority and responsibility,
subject to the approval of the Mayor and confirmation of the City
Council, to set forth written rules and regulations governing the
operation of the Economic Development and Planning Department.

B.
Any subsequent amendments, deletions or changes thereto
shall be subject to the approval of the Mayor and confirmation of
the City Council.
C.
In any case, said rules and regulations or subsequent
amendments, deletions, or changes thereto, shall not be in conflict
with any of the provisions of this article nor anything therein shall
be construed to alter, amend or supersede any of the General Laws
of the Commonwealth of Massachusetts, or the legislative or fiscal
powers of the City Council, or the appointive, administrative or executive
powers of the Mayor.
D.
Pursuant to the adoption of this article and the legal
establishment of the Economic Development and Planning Department,
within 45 days after the appointment of the first Administrator, he
shall submit written rules and regulations of the Economic Development
and Planning Department to the Mayor for approval and subsequent confirmation
by the City Council as set forth by this article.

Should any of the provisions of this article
or any rules or regulations adopted pursuant hereto be found to be
in conflict with the provisions of any existing ordinance, resolution,
rule, regulation or code of the City of Haverhill, the provisions
of this article shall apply.
