The Tree Warden shall, subject to the general authority of the Mayor, exercise the powers and be subject to the duties and liabilities conferred and imposed upon tree wardens and of other officers having charge of public shade trees in cities and towns by the provisions of Chapter 87 of the General Laws.
The Tree Warden may appoint such deputies as the Commissioner of Public Works shall recommend and the City Council shall allow, and he and they shall receive such compensation for their services as the City Council shall determine.
The Tree Warden may make such rules and regulations relative to the preservation and protection of public shade trees, shrubs and growths in the City, subject to the approval of the City Council and not inconsistent with law, as he may deem necessary or expedient. He shall enforce all provisions of law or ordinance relating to public shade trees, shrubs and growths in the City, and shall prosecute, in the name of the City, all violations thereof.
The Tree Warden shall keep accurate and complete records and accounts of all his official acts, receipts and expenditures, which records and accounts shall be at all times subject to the inspection of the City Council, the Mayor, the Auditor of Accounts and the Commissioner of Public Works.[1]

There is hereby established a revolving fund, the proceeds of which are to be used for the purchase of shade trees. This revolving fund shall be kept separate from all other moneys by the City Treasurer and shall be expended by the Tree Warden, but only with the written consent of the Mayor. The provisions of MGL c. 44, § 53D, are hereby accepted insofar as necessary to establish this fund. This fund shall be self-supporting and shall consist of gifts, donations and other moneys received from sources other than the City of Haverhill.

The money in the revolving fund shall be used for the purchase of shade trees to be planted by the Department of Public Works Highway/Parks and Trees Department. The trees shall be planted along public ways or adjoining land as provided by Chapter 87 of the Massachusetts General Laws.

The Tree Warden shall establish the amount of money necessary to plant a commemorative tree in honor of or in memory of a person or persons. A record of trees so planted shall be maintained by the City Clerk and by such public display in City Hall as the Tree Warden, with the approval of the Mayor, shall determine.
