It shall be unlawful to conduct or promote the
solicitation of moneys from any individuals or persons, whether on
public or private property, without a license from the City Council.
An individual or person applying for said license must be a Haverhill
resident and must apply for same in person at the City Clerk's office.

It shall be a condition of said license that
a suitable container, bearing the name of the organization and the
date on which this license applies and a permit number, must be used
and exhibited at the time of solicitation. In addition, a tag or some
other noticeable and/or visible object that can be conspicuously displayed
must be given to each donor, indicating the charity or organization
involved. A sample of the badge and the tag to be given shall be provided
to the City Clerk at the time the permit is issued.
All applications under this chapter and pursuant to Chapter 171, Licensing, of this Code must be made by a duly qualified nonprofit organization or religious or other charitable association conducted exclusively as a nonprofit organization. No individual or person shall conduct such sale or solicitation in front of any private or public premises without the prior written or oral approval of said owner, occupant or tenant.
A.
No license issued under this preceding section shall
be issued for more than three consecutive days only, one day of which
may include solicitation on a public way, nor more than one license
per year per organization will be issued, unless for a reason or reasons
duly accepted by the City Council of the City of Haverhill.

B.
Any organization or association licensed to solicit
on a public way may change the date of the solicitation on the public
way due to inclement weather by providing notice of the date change
to the City Clerk at least 24 hours prior to the first day of the
solicitation, provided that no other organization or association has
been licensed on the date and location for which reassignment is requested.

Application for said license shall be made in conformance with the general provisions relating to such applications, more specifically contained in Chapter 171, Licensing, of this Code. Any person securing said license shall pay a fee of $10 for each day the license is in effect. This shall not pertain to Boy or Girl Scouts, religious organizations and any fund-raising for schools.

No outside solicitors, or those not specifically
a member or participant of the applicant, shall be allowed to conduct
or be a part of any tag day. No children under 16 years of age shall
solicit funds unless the children are accompanied by one adult per
location.

No solicitation on or in a public way shall be allowed, except
that the Haverhill firefighters may solicit for the Muscular Dystrophy
Association every Labor Day weekend from Friday through Monday in
front of the Water Street Fire Station. No further permit from the
City shall be required for this activity.

Any person or organization who violates the
sections of this chapter shall be subject to a fine of $50. Each violation
shall constitute a separate and continuing offense.
