A certain document, one copy of which is on file in the office of the Borough Clerk of the Borough of Cresskill, being marked and designated as the Life Safety Code, and all updated amendments thereto, as published by the National Fire Prevention Association as part of the Fire Prevention Code, be and is hereby adopted as the Life Safety Code of the Borough of Cresskill, County of Bergen, in the State of New Jersey, and each and all of the regulations, provisions, penalties, conditions and terms of the Life Safety Code and updated amendments thereto are hereby referred to, adopted and made a part hereof as if fully set out in this chapter.

Whenever any establishment subject to this chapter and the Life Safety Code shall be subject to a maximum occupancy load and shall be required under the Life Safety Code to post in a conspicuous place a sign displaying such occupancy load, the owners and operators of the establishment shall, upon demand from any authorized Borough official, produce evidence of the number of occupants as the establishment at the time of said demand.
Upon the failure of said owners or operators to produce evidence of the occupancy load and if, in the judgment of the authorized municipal officials, the number of occupants on the premises exceeds the maximum occupancy load as provided under this chapter and the Life Safety Code, said municipal officials may demand the immediate reduction of the number of occupants to the authorized limit. Upon refusal or failure of the operators or owners to so reduce the occupants to the authorized limit, the Borough official or officials shall be authorized to order the vacation of the premises by all occupants.
If the operators or owners of the establishment in question dispute the number of occupants claimed by the Borough officials to be present on the premises, said owners or operators shall adopt immediate reasonable procedures to ascertain jointly with the Borough officials the actual number of occupants on the premises at said time.
Any person violating any provision of this chapter or the code adopted thereby shall, upon conviction thereof, be punished by a fine not to exceed $500 or by imprisonment in the county jail for a term not to exceed 90 days, or both.
