In accordance with the provisions of N.J.S.A. App. A:9-41, the local Emergency Management Council is hereby created. It shall be composed of nine members who shall be appointed by the Mayor and shall hold office at the will and pleasure of the appointing authority.

A.
The local Emergency Management Council shall assist the City in establishing the various local volunteer agencies needed to meet the requirement of all local emergency management activities in accordance with the rules and regulations established by the governor of the state. The local Emergency Management Council is authorized, within the limits of appropriations, to establish an adequate organization to assist in supervising and coordinating the emergency management activities of the City.

The local Emergency Management Council shall prepare a written Emergency Operations Plan with all appropriate annexes necessary to implement the plan. The plan shall conform to all relevant federal and state statutes, rules and regulations concerning emergency operations and shall include the identification of significant hazards affecting the City. The plan shall be based upon planning criteria, objectives, requirements, responsibilities and concepts of operation for the implementation of all necessary and appropriate protective or remedial measures to be taken in response to an actual or threatened emergency as determined by the State Director of Emergency Management. The Plan shall be reviewed and updated at least every two years.
The Director of Public Safety shall appoint a municipal Emergency Management Coordinator from among the residents of the City, who shall serve for a term of three years. As a condition of his appointment and his right to continue for the full term of his appointment, he shall complete the training required by N.J.S.A. App. A:9-40.1.
A.
The municipal Emergency Management Coordinator shall be a member of the local Emergency Management Council and shall serve as its Chairman. He shall be responsible for the planning, activating, coordinating and the conduct of emergency management operations within the City.
B.
Whenever the municipal Emergency Management Coordinator shall determine that a disaster has occurred or is imminent within the City, he shall proclaim a state of local disaster emergency. In accordance with the regulations promulgated by the State Director of Emergency Management, he shall be empowered to issue and enforce such orders as may be necessary to implement and carry out emergency management operations and to protect the health, safety, and resources of the residents of the City.
