The State of New Jersey adopted residential
site improvement standards. The legislature found and declared that
it was in the public interest to avoid unnecessary costs in the construction
process and that uniform site improvement standards for residential
development would be cost effective and predictable for developers.
These site improvement standards adopted in N.J.A.C. 5:21-1.1 et seq.
are incorporated herein as if the same were set forth with particularity.
The standards set forth in the state regulations
for residential development shall supersede any residential site improvement
standards established within this chapter.
Nothing contained in the state regulations adopting
the residential site improvement standards shall be interpreted to
limit the zoning power of the City.
