A.
N.J.S.A. 39:4-56.1(a) makes it unlawful for a person
to operate a motor vehicle upon the public highways of the state in
such a manner as to willfully cause such vehicle to become disabled,
by reason of lack of fuel or otherwise, for the purpose of interfering
with or obstructing the passage of other vehicles.
B.
N.J.S.A. 39:4-56.1(b) makes it unlawful for a person
to willfully abandon a motor vehicle upon the public highways for
the purpose of interfering with or obstructing the passage of other
vehicles.
C.
N.J.S.A. 39:4-56.5(a) makes it unlawful for any person
to abandon a motor vehicle on or along any highway (other than a limited
access highway), or other public property, or on any private property
without the consent of the owner or other person in charge of the
private property. A vehicle which has remained on or along any highway,
or other public property, or on private property without consent for
a period of more than 48 hours or for any period without current license
plates shall be presumed to be an abandoned motor vehicle.
D.
N.J.S.A. 39:4-56.5(b) makes it unlawful for any person
to abandon a motor vehicle on or along any limited access highway
without the consent of the entity having jurisdiction over the limited
access highway. A vehicle which remains on or along such a highway
for a period of more than four hours or for any period without current
license plates shall be presumed to be an abandoned motor vehicle.
E.
N.J.S.A. 39:4-56.6 makes it unlawful for a person
to park or leave unattended a motor vehicle on private property without
the consent of the owner or other person in control or possession
of the property or for a period in excess of the time for which consent
was given. This section authorizes the owner or other person in control
or possession of the property to remove and store the motor vehicle.
In the case of an emergency or disablement of the motor vehicle, the
owner or operator thereof shall arrange for the expeditious removal
of the vehicle.
F.
N.J.S.A. 39:4-56.7 authorizes any law enforcement
officer to enter upon the property upon the request of the property
owner for the purpose of issuing a summons for a violation.
G.
N.J.S.A. 39:3-4 provides that no person owning or
having control over any unregistered vehicle shall permit the same
to be parked or to stand on a public highway. Any police officer is
authorized to remove any unregistered vehicle from the public highway
to a storage place or garage, and the expense involved in such removal
and storing of the vehicle shall be paid by the owner of the vehicle,
except that the expense shall be paid by the lessee of a leased vehicle.
H.
The governing body of the City of Millville finds
and declares that abandoned motor vehicles on or along any public
street or on public property within the City are a nuisance and a
threat to public safety. Accordingly, any police officer is hereby
authorized to remove any abandoned vehicle from those locations to
the municipal storage facility. The expense for towing and storing
of the vehicle shall be assessed in accordance with the towing and
storage regulations contained in this chapter.
