The purpose of this article is to impose an annual user charge, as hereinafter defined, on all domestic, commercial, industrial, and institutional users of the sewer system of the City of Millville.
Unless the context specifically indicates otherwise, the meaning of the terms used in this article shall be as follows:
ANNUAL UNIFORM AMOUNT
The annual sewer charge set by the City for one residential dwelling unit.
DOMESTIC WASTE
Liquid wastes resulting from residences, buildings, institutions, septic tanks, holding tanks, and industrial sources, including the noncommercial preparation, cooking and handling of food, wastewater consisting of human excrement, gray water and similar wastes from sanitary conveniences, swimming pool water, but excluding any mixture which includes any industrial waste, process wastewater, contaminated stormwater, contaminated groundwater, or boiler blowdown. Any wastewater with concentrations above the following criteria will not be considered domestic waste:
EQUIVALENT DWELLING UNIT
The unit of measure that is equal to one residential dwelling unit based on the average number of gallons of sewer flow for one residential dwelling.
INDUSTRIAL WASTE
The process wastewater and other liquid wastes resulting from any industrial manufacturing process defined in the latest edition of the Standard Industrial Classification Manual, or is not domestic waste as defined herein, or is any wastewater from any service process which because of the contaminants it contains is comparable to industrial wastewater including such wastewater mixed with water or domestic waste.
SEWER FLOW
The volume of wastewater discharged to the sewer system. Except for equivalent dwelling units, sewer flow shall be measured by an approved sewer flow meter, or if such a device is not installed, sewer flow shall be measured by the water consumption of the sewer user. Water consumption shall be based on water meter readings for City water and pumping records for private wells, or a combination of both. Sewer users who dispose of wastewater by means other than into the public sewer system shall provide accurate measurements of the volume of wastewater discharged to the public sewer system, otherwise sewer flow shall be the total water consumption.
USER CHARGE
The charge levied upon all users of the City's sewer system for the annual cost of operation, maintenance, capital expenditure and debt service of the wastewater treatment plant, collection lines, pumping stations, treatment facilities and other appurtenances.

Annual sewer user charges shall be made by the municipality to owners of real property upon which improvements stand which utilize the municipal sewer system. The annual uniform amount for each equivalent dwelling unit is hereby established at $520. The sewer user charge shall be based upon equivalent dwelling units in accordance with the following table.

NOTE: All other uses not set forth in the above schedule shall be charged at the rate set for industrial domestic use based on water meter readings, unless sewer flow meter readings are available.

The annual user charge for industrial domestic waste shall be $6.50 per thousand gallons of sewer flow. However, in no event shall the annual user charge be less than the annual uniform amount set for one equivalent dwelling unit.

Where a building or premises is occupied by one or more residential units and nonresidential units which are not separately metered either by a sewer flow meter or a water consumption meter, the sewer user charge shall be determined as follows: $6.50 for each 1,000 gallons or part thereof, subject to a minimum sewer user charge of one EDU for each residential unit plus one EDU for all of the remaining nonresidential units.

Senior citizens and persons totally and permanently disabled and their surviving spouses who have owner-occupied residential dwellings and who qualify for the deduction against their real estate taxes pursuant to N.J.S.A. 54:4-8.40 shall be entitled to an annual credit of $200 against their residential sewer charges.
Where a commercial or industrial establishment has both domestic wastes and industrial wastes and the wastes are commingled and so discharged to the City's sewer system, the industrial waste charge as set forth below shall apply. Any commercial or industrial establishment may, at its option and its own expense, separate its industrial waste from its domestic waste and provide separate connections to the City sewer system for each type of waste. If a commercial or industrial establishment exercises this option, the annual user charge shall be based on the sewer rate for the separate wastes.
A. 
The owner of each commercial or industrial establishment which discharges to the City sewer system industrial waste of other pollutants in violation of § 56-15 of this chapter, shall be charged at the annual user rate for industrial domestic use and in addition be subject to the following surcharges.

The concentrations reported shall be converted from milligrams per liter (mg/l) or parts per million (ppm) to pounds using the following equation:

Charges for installation of facilities and sewer user charges shall become a lien upon the premises of the customer as provided by statute whenever a bill for sewer service or installation remains unpaid 60 days after it becomes due.
Property subject to a lien for unpaid sewer charges shall be sold for nonpayment of same, and the proceeds of such sale shall be applied to pay the charges, after deducting costs, as in the case of foreclosure of statutory liens. The City Attorney is hereby authorized to institute such legal proceedings in the name of the City in any court having jurisdiction over such matters against any property in which sewer charges remain unpaid 60 days after their due date.
